AGENDA ITEM:Consideration of approval of a resolution approving settlement agreement and
easements between Broderick Family, L.P. and the City of Waukee
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: The agreement and easements are necessary for the
construction of the Little Walnut Creek Sewer Phase 3/Indi Run Trunk Sewer
Project. The easements are being approved mid-week due to the fact the trees
have to be down by Saturday, March 31, 2018.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:$135,000.00

THE CITY OF WAUKEE, IOWA
RESOLUTION 18-____________
APPROVING THE SETTLEMENT AGREEMENT AND EASEMENTS BETWEEN
BRODERICK FAMILY, L.P. AND THE CITY OF WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has been in discussion with Broderick Family, L.P. regarding the
conveyance of certain property interests necessary including crop and tree loss for the Little
Walnut Creek Trunk Sewer – Phase 3/Indi Run Trunk Sewer Project in Waukee; AND
WHEREAS, the discussions have resulted in a settlement agreement and easements, and the City
Staff believes it is in the best interest to approve said settlement agreement and easements.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that
the settlement agreement and easements between Broderick Family, L.P. and the City of Waukee
are hereby approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents
to effectuate the closing on behalf of the City, and that the City Clerk shall cause the originals to
be recorded upon the properties by submitting the original to the Dallas County Recorder with
the appropriate recording fees.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 27th day of
March, 2018.
