AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 228, Noise
Control, by amending Section 228.08, Exceptions [Introduction; first
reading]

SYNOPSIS INCLUDING PRO & CON: City staff presented on this matter at the May 14th
City Council work session. The Golf Course requires operational and
maintenance activities such as mowing, watering, hole relocation, range
ball gathering and other operational activities to assure that the public
amenity is ready for daily use by the public. Mowers, golf carts and
other maintenance equipment are used as part of golf course operation
and maintenance to assure proper upkeep and given the physical
characteristics of the golf course property and the surrounding area City
Staff believes it is in the best interest of the community to exempt golf
course operation and maintenance from Chapter 228 of the Waukee
Municipal Code.
As stated in the work session, it is staffs intentions to be a good neighbor
to the surrounding residents. Staff does not anticipate mowing of greens
to take place on the greens located closest to residents until after 7:00
a.m. However, greens that are located furthest from the residential area
will be started around 6:00 a.m. but should not affect any residents.
Staff has checked with other golf courses that are surrounded by
residential development and all of those maintenance crews start
anywhere from 5:00 – 6:30 a.m.
The restrictions on maintenance affect the types of outings we can offer
at the golf course. If maintenance crews are not able to start until after
7:00 a.m., the earliest golf outing we can book is 9:00 a.m. Mowing
times increase from one hour and fifteen minutes to closer to three hours
based on the number of golfers.
In the past starting June 1st we have started taking tee times for 6:30 a.m.
due to demand from golfers. Without an exemption, the earliest tee time
would be 7:00 a.m.

ORDINANCE AMENDING SECTION 228.08 OF THE WAUKEE MUNICIPAL CODE
TO EXEMPT GOLF COURSE OPERATIONS AND MAINTANENCE ACTIVITIES
FROM CHAPTER 228 OF THE WAUKEE MUNICIPAL CODE.
WHEREAS, the City owns and operates the golf course known as Sugar Creek Golf
Course; AND
WHEREAS, the Golf Course requires operational and maintenance activities such as
mowing, watering, hole relocation, range ball gathering and other operational activities to assure
that the public amenity is ready for daily use and manicured so as to remain a visual amenity to
surrounding property owners and the general public; AND
WHEREAS, mowers, golf carts and other maintenance equipment are used as part of
golf course operation and maintenance to assure proper upkeep and given the physical
characteristics of the golf course property and the surrounding area the City believes it is the best
interest of the community to exempt golf course operation and maintenance from Chapter 228 of
the Waukee Municipal Code.
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee, Iowa
that Section 228.09 of the Waukee Municipal Code should be amended to add the following
exception to the noise ordinance:
Section 1. Section 228.08(13). The emission of sound from the operation of mowers,
golf carts and other equipment utilized for operational and maintenance activities on the real
property known as Sugar Creek Golf Course.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect from and after its final
passage, approval and publication as provided by law.
