HomeMy WebLinkAbout2018-08-20-H01 Vacation of Easement -The Shops at Kettlestone North Plat 1 - PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: August 20, 2018 AGENDA ITEM: A public hearing on the vacation of a Storm Water Management Facility Maintenance Covenant and Permanent Easement Agreement [The Shops at Kettlestone North Plat 1] FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: As a part of the final plat approval for The Shops at Kettlestone North Plat 1, a Storm Water Management Facility Maintenance Covenant and Permanent Easement was approved which encompassed the whole property being final platted which includes property both on the west and east sides of Grand Prairie Parkway. The Covenant/Easement was established for purposes of conveyance of storm water from the individual l ots within the plat as well as long term maintenance of the large detention pond that is being constructed in the southwest corner of the plat. It has been determined that not all of the property that was originally included within the easement will convey their storm water to the detention pond along Ashworth Road and therefore those properties should not be included in the responsibilities for maintenance of the pond. A majority of the property was recently replatted as a part of The Shops at Kettlestone North Plat 4. As a part of that final plat, a new storm water management and maintenance covenant was recorded which places the responsibility for maintenance of the pond in question with the appropriate property. In order to dispose of the original easement, the City Council needs to hold a public hearing on the vacation. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: With the approval and recording of the new easement with Plat 4, the easement previously approved with Plat 1 is no longer needed and it is recommended that it be vacated. RECOMMENDATION: Hold the Public hearing ATTACHMENTS: I.
