RESOLUTION 18-
APPROVING THE VACATION OF A STORM WATER MANAGEMENT FACILITY
MAINTENANCE COVENANT AND PERMANENT EASEMENT AGREEMENT
ACROSS THE SHOPS AT KETTLESTONE NORTH
PLAT 1
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has previously approved a final plat for The Shops at Kettlestone North
Plat 1, which included a Storm Water Management Facility Maintenance Covenant and
Permanent Easement Agreement recorded in Book 2017 Page 5162 (the “Easement”); AND,
WHEREAS, it has been determined that the Easement as described on attached Exhibit A is no
longer needed; AND,
WHEREAS, the property owner has requested that the easement as described in attached
Exhibit A be vacated.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
20th day of August 2018, that it hereby approves the vacation of the Storm Water Management
Facility Maintenance Covenant and Permanent Easement Agreement across a portion of The
Shops at Kettlestone North Plat 1.

EASEMENT TO BE VACATED
Storm Water Maintenance Covenant and Permanent Easement Agreement (Book 2017, Page 5162)
A Public Detention Easement located in The Shops at Kettlestone North Plat 1, an Official Plat, City of
Waukee, Dallas County, Iowa, that is more particularly described as follows: Beginning at the Southwest
corner of said plat; thence N00⁰18’55”E, 409.78 feet along the West line of said plat; thence
N80⁰14’06”E, 210.25 feet; thence S84⁰58’29”E, 53.43 feet, thence S51⁰40’56”E to a point of curvature of
965.00 feet radius curve concave to the Northwest; thence Southwesterly, 124.64 feet along said curve,
said curve has a chord length of 124.64 feet and a chord bearing of S19⁰14’36”W to a point of reverse
curvature 535.00 feet radius curve concave to the Southeast; thence Southwesterly 250.80 feet along
said reverse curve , said reverse curve has a chord length of 248.51 feet and a chord bearing of
S09⁰30’59”W, to a point of reverse curvature 25.00 feet radius curve concave to the Northwest; thence
Southwesterly, 38.26 feet along said curve, said curve has a chord length of 34.63 feet and a chord
bearing of S39⁰55’47”W to the South line of said plat; thence S83⁰46’21”W, 197.43 feet to the Point of
