AGENDA ITEM:Consideration of approval of a resolution approving Retainage Release of
Funds Agreement with Pohlmeier Construction, Inc. related to the Southwest
Area Trunk Sewer Extension Project
FORMAT:Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The City has received a claim from two subcontractors
related to work performed under contractor Pohlmeier Construction, Inc., for
the Southwest Area Trunk Sewer Extension Project. The City and Pohlmeier
have come to an agreement related to payment to subcontractors by the City
using retained funds for the project.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: The City Attorney has reviewed the agreement and finds it
satisfactory.
RECOMMENDATION: Approve the resolution.

RESOLUTION 18-
APPROVING RETAINAGE RELEASE OF FUNDS AGREEMENT WITH POHLMEIER
CONSTRUCTION, INC. RELATED TO THE SOUTHWEST AREA TRUNK SEWER
EXTENSION PROJECT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City of Waukee entered into a contract with Pohlmeier Construction, Inc. for
the construction of the Southwest Area Trunk Sewer Extension Project; AND,
WHEREAS, the project was completed and accepted on June 4, 2018 (Resolution #18-223);
AND,
WHEREAS, the City and Pohlmeier Construction, Inc., have reached an agreement, attached
hereto as Exhibit A, related to distribution of retained funds.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 20th day of August, 2018, that it hereby approves the Retainage Release of Funds Agreement
with Pohlmeier Construction, Inc. related to the Southwest Area Trunk Sewer Extension Project.
BE IT FURTHER RESOLVED that the City of Waukee shall withhold payment of the
$11,684.64 balance due to Pohlmeier Construction, Inc., until Pohlmeier Construction, Inc., shall
submit balance due payment to the City in the amount $1,178.21.
