HomeMy WebLinkAbout2018-10-01-J01M Hougham Lot 1 Rezoning_Set PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 1, 2018 AGENDA ITEM: Consideration of approval of a Motion to set a Public Hearing Date of October 15, 2018, as the date of public hearing on an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 Agricultural District to M-1 Light Industrial District (Lot 1 of Hougham Subdivision) FORMAT: Motion SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of approximately 8 acres of property from A-1 Agricultural District to M-1 Light Industrial District. The property is located south of Interstate 80 and west of Ute Avenue. The subject property was recently approved for annexation by the City of Waukee. Note that the annexation will not be finalized until it has been approved by the City Development Board which is scheduled for November. The applicant is requesting consideration to rezone the property subject to approval of the annexation. The Zoning Ordinance states that the applicant should provide signatures of consent from 50% of the surrounding property. In this case, because of its location, the property is only surrounded by 3 adjacent properties with one property making up 58% of the surrounding property. The applicant has been unable to obtain the signature from the one property owner and therefore falls short of the 50% provision. The Ordinance stipulates that the City Council can set a public hearing on the applicant’s behalf in the case that an applicant is unable to receive signatures from surrounding property owners. The applicant is requesting the City Council go ahead and set a public hearing date to discuss the proposal. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend a public hearing date be set for October 15, 2018, to further discuss the proposed changes.
