AGENDA ITEM:Consideration of approval of a resolution approving final plat for
Westgate Business Park Plat 4
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: Aztec Properties, LLC, is requesting approval of a
final plat for an approximately 3.08-acre subdivision located north of SE
Olson Drive and west of SE Alice’s Road. The proposed final plat
includes a total of two (2) lots for future business/industrial park
development. Lot 1 is proposed to be 1.11-acres in area and Lot 2 is
proposed to be 1.96-acres in area. The lots currently existing as Lots 12
and 13 of Westgate Business Park Plat 2. The proposed plat would make
Lot 12 smaller and Lot 13 larger. No public improvements are required
at this time for the plat.
The Planning & Zoning Commission reviewed this proposal at their
meeting on August 14, 2018, and recommended approval. The plat that
the Commission review included two additional lots to the west that
would be replatted. After the Planning & Zoning Commission hearing,
the applicant chose to only replat the two lots now indicated on the final
plat. Because the overall proposal has not changed significantly this
change does not require additional review from the Planning & Zoning
Commission.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:The Planning and Zoning
Commission reviewed the request at their meeting on August 14,
2018 and recommended approval:

City Planner, Andy Kass, introduced the request made by the applicants, Aztec Properties LLC
and Jace Properties, LLC. The Applicants are requesting approval of a preliminary and final plat
for the subject property located north of SE Olson Drive and west of SE Alice’s Road for a light
industrial subdivision. Mr. Kass advised that the subject property was originally included as a part
of Westgate Business Park Plat 2, however, the property owner has chosen to re-plat lots 10-13
into two lots to allow for future expansion of an existing business and additional development at
the intersection of SE Olson Drive and SE Alice’s Road.

Mr. Kass advised that no public streets or trails are planned or required as part of the plat, and all
utilities are in place to serve each lot. Storm water detention is provided in the regional retention
basin to the south and west of the property.
At this time Staff recommends approval subject to remaining staff comments and review of the
legal documents.
Commissioner Streit questioned what the current business, Access Systems, does. Mr.
Kass advised that they are an IT Business among other things.
Commissioner Broderick questioned if Access Systems owned the ground. Mr. Kass
advised that Jace Properties Owns the ground that Access sits on, Aztec Properties owns
other portions of the subject property.
Commissioner Streit moved to approve a final plat for Westgate Business Park Plat 4 subject to
remaining staff comments and review of the legal documents. Commissioner Sandie seconded the
motion. Ayes: Ward, Sandie, Streit, Tietz, Broderick, and Hoifeldt. Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: Staff’s position is that the proposed final plat meets the
intent and the requirements of the M-1/PD-1 Zoning District and the
Comprehensive Plan.
RECOMMENDATION: Staff recommends approval of the Final Plat for Westgate Business
Park Plat 4.

APPROVING THE FINAL PLAT FOR WESTGATE BUSINESS PARK PLAT 4
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, AZTEC PROPERTIES, LLC, has requested final approval of Westgate Business Park
Plat 4 (the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat
on August 14, 2018, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Westgate Business Park Plat 4 and the documents relating thereto will
comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this
1st day of October, 2018, that the Final Plat for Westgate Business Park Plat 4 be and the same is
hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements
and documents to be filed with the Plat:
1. Public Utility Easement, and
2. Access Easement (Private)

HISTORY
The subject property is located north of SE Olson Drive and west of SE Alice’s Road. The property included within the
plat was platted in 2000 as part of Westgate Business Park Plat 2. The property owner has chosen to replat Lots 10, 11,
12, and 13 of Plat 2 into two lots to allow for future expansion of an existing business currently located on Lot 10 and
for additional development at the intersection of SE Olson Drive and SE Alice’s Road.
PROJECT DESCRIPTION
LOTS
The preliminary plat and final plat identify a total of two (2) lots for light industrial development. Lot 1 is 4.17 acres in
area and Lot s is Bulk regulations for the M-1/PD-1 Zoning District are provided in Table 1. All proposed lots meet the
minimum requirements of the M-1/PD-1 zoning district.

STREETS AND TRAIL
No public streets or trails are planned or required as part of this plat. Sidewalks will be constructed along SE Olson

southwest of the property.

EASEMENTS
All proposed easements have been indicated on the preliminary plat and final plat.
STAFF RECOMMENDATION
All proposed lots meet the minimum requirements of the Zoning Ordinance, the preliminary plat and final plat are in
general conformance with the Subdivision Ordinance, and the proposed land use of the property is consistent with the
Comprehensive Plan. Staff recommends approval subject to remaining staff comments and review of the legal
documents.
