HomeMy WebLinkAbout2018-10-15-I02 Hougham Subdivision Rezoning - PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 15, 2018 AGENDA ITEM: Public Hearing on an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee Iowa, by rezoning certain property from A-1 to M-1, a property known as Lot 1 of Hougham Subdivision. FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a rezoning of approximately 8 acres of property that is located on the west side of R-22 (Ute Avenue) and is generally located south of Interstate 80. The property was recently annexed into the City of Waukee. The application has been submitted to the City Development Board for consideration and it is anticipated that the annexation would be completed by the end of the year. The proposed rezoning is subject to completion of the annexation. The applicant is requesting rezoning of the property to M-1 Light Industrial to facilitate the development of an approximately 30,000 square foot warehouse/office building. The proposed use is consistent with the draft of the Comprehensive Plan that will be considered by the City Council later this year. As a part of the application, the applicant has provided a concept plan identifying the layout of the property. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed this request at their meeting on October 9, 2018 and recommended approval: Approval of a Rezoning related to a Change from A-1 (Agricultural District) to M-1 (Light Industrial District) [Hougham Plat 1] City Planner, Andy Kass, introduced the request for approval of a rezoning to the Light Industrial District, made by the applicants Skogman Realty, Jean & Larry Mark, and Nona & Gordon Martens. The subject property is generally located south of Interstate 80 and west of Ute Avenue, containing approximately 7.99 acres. The subject property is currently located within Dallas County, but has taken action on a Voluntary Annexation September 17th, 2018. There are a few more steps before the annexation is complete and any further development on the property will be subject to the finalization of the annexation. The rezoning would bring the property into the City consistent with the Proposed Comprehensive Plan titled Waukee 2040. The applicant has provided a concept plan which identifies the development of an approximately 30,000 square foot building with enclosed outdoor storage. Access would be provided off of Ute Avenue and work continues to be done in order to extend utilities to the property. Mr. Kass advised I2 that the development would run on a septic system through Dallas County, but would be connected to Public water utilities. Staff would recommend approval of the rezoning subject to the completion of the voluntary annexation process.  Commissioner Tietz questioned the future of the septic services once a sewer connection was available. Mr. Kass advised that when there is a connection available, the owner will be able to hook into public utilities upon the failure of the septic system or at their discretion.  Dana Tonelli of 3323 Ute Ave. questioned about what the Comprehensive Plan was, and why she wasn’t provided a copy. Mr. Kass advised that the Comprehensive Plan, in short, is a guiding document for the development goals of the City. It has been in Process for a little over a year and there have been public forums and open houses regarding its creation. Most of the documentation from these meetings are available on the City website as well. Commissioner Hoifeldt moved to approve the rezoning related to a change from A-1 (Agricultural District) to M-1 (Light Industrial District) [Hougham Plat 1], subject to any remaining staff comments and completion of the voluntary Annexation. Commissioner Sandie seconded the motion. Ayes: Sandie, Streit, Tietz, Broderick, and Hoifeldt. Nays: None. Motion Carries. The City Council took action on the annexation of the property on September 17, 2018. The proposed annexation has been forwarded to the State City Development Board for action. It is anticipated that the City Development Board will hold a public hearing on the annexation in November. Pending approval and a 30 day appeal period, the annexation of the property into the City limits will be completed by the end of the year. The requested rezoning is subject to completion of the voluntary annexation of the property. PROJECT DESCRIPTION The owner and applicant are requesting approval of a rezoning of the property from A-1 Agricultural District to M-1 Light Industrial District to allow for the development of an approximately 30,000 square foot business/warehouse on the property. The City Council has set a public hearing date for October 15, 2018 to further discuss the proposed rezoning request. The City of Waukee is currently in the final stages of the completion of a new Comprehensive Plan titled Imagine Waukee 2040. The proposed Comprehensive Plan identifies the use of the property as light industrial/office use which is consistent with the proposed development concept. The subject property is located slightly south of the Interstate 80 Industrial Park of which the second phase was just recently completed. It is intended that the remaining property between the existing business park and proposed project would fill in with similar type uses. It is also anticipated that an additional east/west street would be extended to the north of this project in the future to provide for a connected transportation network within the intended business park area. The applicant has provided a concept plan which identifies the development of an approximately 30,000 square foot building with enclosed outdoor storage. Access would be provided off of Ute Avenue. The applicant continues to work on plans for the extension of utilities to serve the site. Water is located to the north of October 5, 2018 3 of 3 the site and would be extended to serve the property. The applicant has been working with Dallas County regarding the ability for a septic system to serve the property. There is currently no sewer available to thi s property and the eventual trunk sewer would come from the east of the site up the Johnson Creek area. There is no timeframe for the extension of that trunk sewer. Imagine Waukee 2040: Land Use Plan identifying the subject property STAFF RECOMMENDATION The proposed rezoning request is consistent with the proposed Imagine Waukee 2040 Comprehensive Plan and is consistent with the existing Interstate 80 Business Park located to the north of the project. Staff would recommend approval of the rezoning subject to completion of the voluntary annexation process.
