HomeMy WebLinkAbout2018-11-05-J02 City Administrator Duties_INTRO, 1st READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: November 5, 2018 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 108.6, Waukee Municipal Code, clarifying some employment-related duties of the City Administrator [introduction, first reading] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: At the 10/08/2018 special meeting, the Waukee City Council discussed possible amendments to the powers and duties of the City Administrator: City Council approval of department director appointments, suspensions, terminations – City Attorney Brick reviewed the current ordinance and asked the council what role they wanted to play in hiring and potential disciplinary measures for department directors. After much discussion, the council agreed to give the city administrator full authority to appoint, suspend, or terminate department directors with the understanding that the city administrator will make the council aware of any such actions, especially if there are any potential legal issues or concerns. City Administrator Moerman proposed drafting a protocol on how he would keep the council aware of such actions related to department directors. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the first reading of the ordinance. RECOMMENDATION: Introduce the ordinance and approve the first reading in title only. ATTACHMENTS: I. Proposed Ordinance PREPARED BY:Becky Schuett REVIEWED BY: J2 1 ORDINANCE NO. _________ AN ORDINANCE TO AMEND CHAPTER 108.6, WAUKEE MUNICIPAL CODE, CLARIFICATING SOME EMPLOYMENT RELATED DUTIES OF THE CITY ADMINISTRATOR. WHEREAS, as part of responsible management of the City, the City strives to review its ordinances and laws to assure best practices and procedures are implemented consistent with the man power and resources available to the City; and WHEREAS, the City has over the years established a human resource department and enhanced the resources and capabilities of City Administration; and WHEREAS, given these added efficiencies the City Council of the City of Waukee seeks to stream line and clarify the responsibilities and duties of the City Administrator with reference to the supervision, employment, discipline and discharge of employees within the City in a manner consistent with the staff and resources available to the City now and in the foreseeable future. BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1: Chapter 108.6, Waukee Municipal Code, subsection 10 should be and the same is hereby repealed and enacted in lieu thereof is as follows §108.6(10) Appoint and Employ. Have the power to appoint or employ all officers and employees to fill authorized positions with the exception of the City Clerk, City Attorney and police department personnel. Section 2: Chapter 108.6, Waukee Municipal Code, subsection 11 should be and the same is hereby repealed and enacted in lieu thereof is as follows §108.6(11) Suspension or Discharge of Employees. Have the power to suspend without pay or discharge summarily any officer or employee which the City Administrator has the power to appoint or employ, subject, however, to the provisions of the Veteran’s Preference Law, Chapter 35C of the Code of Iowa and applicable provisions of THE HANDBOOK FOR EMPLOYEES OF THE CITY OF WAUKEE and applicable Federal, State, or local law. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. 2 Section 6. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
