AGENDA ITEM: Consideration of approval of a motion setting December 17, 2018 as the date
of public hearing on the vacation of a Surface Water Flowage and Storm
Sewer Easement [Southfork Woods Plat 2 Lot 22]
FORMAT: Motion
SYNOPSIS INCLUDING PRO & CON: As a part of the final plat for Southfork Woods Plat 2, a
Public Surface Water Flowage and Storm Sewer Easement was dedicated to
the City across Lot 22. In 2004 a proposed amendment to the easement area
across Lot 22 was proposed, but never brought forth to the City Council. A
portion of the existing house on the property is located within the existing
easement area. The property owner expressed interest in amending the
easement to allow for greater buildable area on the property. Veenstra and
Kimm had reviewed the revised documentation for the new easement and
concurred with the new easement limits. Staff is recommending the existing
easement be vacated and a new easement be provided. In order to dispose of
the portion of the public easement that is not necessary, the City Council must
first hold a public hearing to discuss the matter.

STAFF REVIEW AND COMMENT: Staff would recommend approval of setting the public
hearing date for December 17, 2018 to discuss the vacation of the easement.
RECOMMENDATION: Approve the motion.
