HomeMy WebLinkAbout2018-12-17-H02 Lot 22 of Southfork Woods Plat 2_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 17, 2018 AGENDA ITEM: A public hearing on the vacation of a portion of a Surface Water Flowage and Storm Sewer Easement [Southfork Woods Plat 2 Lot 22] FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: As a part of the final plat for Southfork Woods Plat 2, a Public Surface Water Flowage and Storm Easement was dedicated to the City across a substantial portion of the rear of Lot 22. In 2004, Veenstra and Kimm reviewed the easement in question and recommended that a portion of the easement could be vacated based upon storm water calculations provided. A proposed amendment to the easement area across Lot 22 was prepared, however it appears at that time there was never any further action taken to vacate the existing easement and approve the new easement. The current property owner has expressed interest in amending the easement as a portion of the existing house is within the easement area and the owners have an interest in installing a pool within the rear yard. In order to dispose of the existing easement and approve the amended easement, the City Council needs to hold a public hearing on the vacation. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend holding the public hearing.
