vacate the existing easement.

RESOLUTION 18-
APPROVING THE VACATION OF A SURFACE WATER FLOWAGE AND STORM
SEWER EASEMENT ACROSS LOT 22 OF SOUTHFORK WOODS PLAT 2
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, a Surface Water Flowage and Storm Sewer Easement (“Easement”) was approved
as a part of the final plat for Southfork Woods Plat 2 and recorded in Book 2000 Page 8844
within Dallas County, Iowa to allow for the construction of storm sewer utilities and surface
water flowage across Lot 22 of Southfork Woods Plat 2; AND,
WHEREAS, it has been determined that a portion of the easement over Lot 22 of Southfork
Woods Plat 2 is not needed; AND,
WHEREAS, the property owner has requested that the Easement as recorded in Book 2000
page 8844 as it pertains specifically to Lot 22 of Southfork Woods Plat 2 be vacated and a new
easement be approved.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
17th day of December, 2018, that it hereby approves the vacation of the Surface Water Flowage
and Storm Sewer Easement across Lot 22 of Southfork Woods Plat 2.
