AGENDA ITEM: Consideration of approval of a resolution approving Settlement Agreement
related to the Alice’s Road Corridor Improvements, Phase 4
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: This is a negotiated agreement between the 3 Parties and
City Staff for the Alices Road Phase 4 road construction. The main points of
the agreement are:
The Parties will provide temporary construction easements.
The Parties will provide a revised storm water sewer/surface water flowage easement.
The City will construct a full access intersection and access road for the loss of the full access
at the existing Gilcrest Jewett access.
The Parties will be able to install at their own cost a traffic signal at the full access.
The Agreement defines the future accesses along Alices Road.
The Agreement defines who’s responsible for what transformer relocation costs.
The Agreement defines the reinstallation of the fences after construction.

RESOLUTION 17-
APPROVING SETTLEMENT AGREEMENT RELATED TO THE ALICE’S ROAD
CORRIDOR IMPROVEMENTS, PHASE 4
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, in order to move forward with construction of the Alice’s Road Corridor
Improvement Project, Phase 4 (the “Project”), a Settlement Agreement has been negotiated
between the City of Waukee; Gilcrest/Jewett Lumber Company; DJN, LLC d/b/a Fireplace Stone
& Patio; S&P Development, LLC; and Plumb Supply Company, LLC (the “Agreement”); AND,
WHEREAS, the Agreement addresses certain matters among the parties related to property
acquisition and access.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
16th day of January, 2017, that it hereby approves the Settlement Agreement related to the
Alice’s Road Corridor Improvements, Phase 4.
