Hickman Rd. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor William F. Peard; Council Members Anna Bergman, R. Charles Bottenberg, Shelly Hughes, Larry R. Lyon. Absent: Council Member Brian Harrison. Also present: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public Works Director John Gibson, Senior Planner Andy Kass, Community and Economic Development Director Dan Dutcher, Parks and Recreation Director Matt Jermier, Library Director Kristine Larson, Marketing and Communications Director Summer Evans, Human Resource Director Patty Holden, Police Chief John Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum – Tim Wilson, 125 Northview Dr., restated his concerns from the 02/21 regular city council meeting open forum regarding the high number of buses and semis driving along Northview Dr. City Administrator Moerman noted that he would have a report on the matter for the 03/20 council meeting. (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Bergman. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. (F) Mayor’s Report – Mayor Peard noted that Safety City online registration is now open. The Waukee Cemetery is holding their spring clean-up on 04/01-04/15. The City Wide Clean-up has been expanded to a full week 05/01-05/06. (G) Presentations: 1) Waukee Planning & Zoning Commission report – Report made by Commissioner Stormy Shanks. 2) Waukee Park Board report – Report made by Board Member Ethan Owens. 3) Waukee Public Library Board of Trustees report – Report made by Trustee Darcy Burnett. (H) Public Hearings: 1) On an ordinance to amend Chapter 300, Zoning Ordinance, City of Waukee, Iowa, by amending Section 301.8(I), General Regulations – Home Occupations – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Senior Planner Kass briefly reviewed the ordinance revisions, which address contract employees, use of accessory structures, and specific provisions related to swimming lessons. Mayor Peard invited public comment on the matter: 1) Ben Twigg, 565 Spyglass Ln., stated that he and his wife offer swimming lessons at their home and thanked the council for their consideration of the proposed ordinance. 2) On an ordinance to amend Chapter 300, Zoning Ordinance, City of Waukee, by amending Section 301.8(P), General Regulations – Temporary Uses – Sale of Agricultural Products – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Senior Planner Kass briefly reviewed the ordinance revisions, which will not apply to the Farmer’s Market, seasonal produce stands, or mobile food trucks. Mayor Peard invited public comment on the matter: 1) Steve Banks, 2535 Deercreek Trail, Urbandale, and business owner in the Downtown Triangle District, asked the council to consider protecting the investments of those business owners with fixed-base assets. He also voiced concern with the practicality of a temporary business and structure providing restroom facilities, as well as such businesses having a possible negative impact on the downtown aesthetic. 3) On plans, specifications, form of contract and estimate of cost [Northwest Area Trunk Sewer Extension Phases 2 and 3/Copeland Trunk Sewer Phase 1 Projects] – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public Works Director Gibson briefly reviewed the project 2 and the areas to be serviced by the proposed trunk sewers. No comments were made by the public present. 4) On plans, specifications, form of contract and estimate of cost [Alice’s Road Corridor Improvements Phase 4 Project, University Avenue to Olson Drive] – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Public Works Director Gibson briefly reviewed the project, including construction staging. No comments were made by the public present. 5) On a proposed City of Waukee FY2018 budget – Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. City Administrator Moerman briefly reviewed the proposed budget, including revenue and expenditure general fund impact, staffing additions, an increase in sewer rates, public safety facility needs assessment, and certain capital improvement projects. Mr. Moerman also stressed that the tax levy would remain at $13.50 per $1,000 taxable valuation. No comments were made by the public present. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 300, Zoning Ordinance, City of Waukee, Iowa, by amending Section 301.8(I), General Regulations – Home Occupations [introduction; first reading] – Council Member Lyon introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Bergman. Council Member Bottenberg asked for the definition of an accessory structure; Senior Planner Kass reviewed the definition. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. 2) Ordinance: Consideration of approval of an ordinance to amend Chapter 300, Zoning Ordinance, City of Waukee, by amending Section 301.8(P), General Regulations – Temporary Uses – Sale of Agricultural Products [introduction; first reading] – Council Member Bergman introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. 3) Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost [Northwest Area Trunk Sewer Extension Phases 2 and 3/Copeland Trunk Sewer Phase 1 Projects] – Council Member Lyon moved to approve the resolution; seconded by Council Member Bottenberg. Public Works Director Gibson reviewed the construction timeline and bid tabulation, recommending the contract be awarded to Vanderpool Construction of Indianola, IA, in the amount of $820,320.00. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. (Resolution #17-113) 4) Resolution: Consideration of approval of a resolution awarding contract [Northwest Area Trunk Sewer Extension Phases 2 and 3/Copeland Trunk Sewer Phase 1 Projects] – Council Member Lyon moved to approve the resolution; seconded by Council Member Bottenberg. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. The contract was awarded to Vanderpool Construction of Indianola, IA. (Resolution #17-114) 5) Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost [Alice’s Road Corridor Improvements Phase 4 Project, University Avenue to Olson Drive] – Council Member Bottenberg moved to approve the resolution; seconded by Council Member Hughes. (Resolution #17-115) 6) Resolution: Consideration of approval of a resolution awarding contract [Alice’s Road Corridor Improvements Phase 4 Project, University Avenue to Olson Drive] – Council Member Lyon moved to approve the resolution; seconded by Council Member Bottenberg. Public Works Director Gibson reviewed the construction timeline and bid tabulation, recommending the contract be awarded to Concrete Technologies, Inc., of Grimes, IA, in the amount of $6,474,076.95. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. The contract was awarded to Concrete Technologies, Inc., of Grimes, IA. (Resolution #17-116) 7) Resolution: Consideration of approval of a resolution approving contract, bond [Alice’s Road Corridor Improvements Phase 4 Project, University Avenue to Olson Drive] – Council 3 Member Bottenberg moved to approve the resolution; seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Hughes, Lyon. Nays: None. Absent: Harrison. Motion carried 4 – 0 – 1. (Resolution #17-117) 8) Resolution: Consideration of approval of a resolution adopting the City of Waukee FY2018 budget – Council Member Lyon moved to approve the resolution; seconded by Council Member Hughes. Council Member Bottenberg stated that he would abstain on the matter, as he was chairperson of the Waukee Area Chamber of Commerce at the time that funding for that organization was requested. Results of vote: Ayes: Bergman, Hughes, Lyon. Nays: None. Abstention: Bottenberg. Absent: Harrison. Motion carried 3 – 0 – 1 – 1.
