The City received pricing from three companies for blanket bid pricing to analyze pricing staff used historical information by using all the blanket construction quantities from 2016 and applied contractors pricing to award contract. Bid Tab PREPARED BY: Beth Richardson REVIEWED BY: John Gibson PUBLIC NOTICE INFORMATION — NAME OF PUBLICATION: DATE OF PUBLICATION: THE CITY OF WAUKEE, IOWA RESOLUTION 17- APPROVING 2017 GAS WORK BLANKET BID TO INFRASOURCE CONSTRUCTION, LLC (REVISED) IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WA UKEE, IOWA WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County; AND, WHEREAS, the City contracts with certain companies for gas main installation, steel gas pipe replacement, large service line installation and repair during the construction phase of new subdivisions in the City; AND, WHEREAS, Waukee Public Works requested blanket bids for such services; AND, WHEREAS, using the blanket bids, the Waukee Public Works Department computes the lower bidder for an average City project and awards the contract based on that analysis with the low bidder for the work to be completed; WHEREAS, on April 3, 2017, the Waukee City Council approved a blanket bid from InfraSource Construction, LLC (Resolution #17-175); AND, WHEREAS, the terms and provisions of the blanket bid have since been revised; NOW THEREFORE BE IT RESOLVED that the revised blanket bid from InfraSource Construction, LLC, attached hereto as Exhibit A, should be and the same is hereby approved. Delays due to others may result in a change order for labor and equipment. • Pricing is based on "new" installation. • Delays caused by others or by archeological/hazardous material discoveries may be negotiated through a change order. • Proposal does not include the cost of crop damage within the project boundaries. Any crop damage cost associated with normal construction activities would be the responsibility of the others unless noted in the RFP. • Pricing based on any excess fill remaining on the property where it was excavated. No haul off of excess spoil is included and will be billed at lime and material rates attached. • Extensive dewatering is not included, and would need to be billed accordantly. • Proposal does not include the cost of permitting. All permitting to be provided by others. • Proposal assumes that native fill will be used. InfraSource has included the cost to maintain the top soil from freezing throughout the project. • Service pricing based on receiving a Y. " or 1" PLS Hot Tie In Unit paid for each service. • Please note we added an additional Unit to cover 2" PLS Hot Tie Ins - this unit is highlighted in yellow. • InfraSource currently maintains equipment to perform up to 4" Low pressure taps. Any other taps performed would be subcontracted and billed at cost plus 15%. • Any subcontracting and or materials purchased to be invoiced at cost (including any and all taxes, fees etc.) plus 15%. • By passes would be project specific and priced per each at that time. • Terms - Net 30. Proposal does not include the cost associated with boring/trenching in rock. If rock is encountered, it will be billed at a rate negotiated between InfraSource and the Owner. • Milestones will need to be adjusted if rock is encountered. Terms and Conditions 1. Cross Indemnification. InfraSource shall defend, indemnify and hold harmless City of Waukee and its employees and agents thereof, from and against liability, loss, damage and expense, including reasonable attorneys' fees and costs, incurred or suffered by them, to the extent such liability, loss, damage or expense is attributable to the negligence of InfraSource in and during performing the services. The City of Waukee shall defend, indemnify and hold harmless InfraSource and its affiliates, subcontractors and suppliers, and the directors, officers, shareholders, employees and agents thereof, from and against liability, loss, damage and expense, including reasonable attorneys' fees and costs, incurred or suffered by them, to the extent such liability, loss, damage or expense is attributable to the negligence of the City of Waukee. 2. Waiver of Certain Damages_ InfraSource shall not have any liability or responsibility to the City of Waukee for pre-existing environmental contamination or conditions or Hazardous Materials at, on or related to the job site, excepting only Hazardous Materials brought on to the job site by InfraSource or its subcontractors, legally -protected, endangered or threatened species or habitat at, on or related to the job site, archeological, historical or cultural artifacts InfraSource Construction LLC 6301 James A Reed Rd., Kansas City, MO or resources at, on or related to the job site, or unknown or abnormal job site conditions, including karst formations, sinkholes and voids. 3. Insurance. While performing services under this Agreement, InfraSource shall carry insurance at the following minimum insurance coverages: (a) Workers' Compensation insurance with statutory limits, as required by the state in which the work is to be performed, and employer's liability insurance with limits of one million dollars ($1,000,000). (b) Commercial general liability insurance providing bodily injury, property damage, and personal injury/advertising injury with a combined single limit of two million dollars ($2,000,000) per occurrence, five million dollars ($5,000,000) general aggregate and two million dollars ($2,000,000) products/completed operations aggregate. This must be on an occurrence reporting form and must include contractual liability coverage. (c) Automobile liability insurance for owned, non -owned, and hired autos with a combined single limit of one million dollars ($1,000,000) per accident. (d) Excess or Umbrella liability insurance with a combined single limit of five million dollars ($5,000,000) per occurrence and aggregate. InfraSource shall submit to City of Waukee upon request certificates evidencing coverages of the types and limits set forth above and provide that no cancellation of the policies become effective except on prior written notice to City of Waukee.
