AGENDA ITEM: Consideration of approval of an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from R-1
to R-2, a property to be known as Daybreak Plat 2 [third (final) reading]

STAFF REVIEW AND COMMENT: Staff would recommend approval of the third
consideration to rezone the property.
RECOMMENDATION: Approve the third reading of the ordinance in title only and place on
final passage.

AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE,
IOWA BY AMENDING CERTAIN PROPERTY FROM R-1 TO R-2 [DAYBREAK PLAT 2]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of
the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate
from R-1 (Single Family Residential District) to R-2 (One & Two Family Residential District), legally
described as follows:
BEING A PART OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF
SECTION 6, TOWNSHIP 78 NORTH, RANGE 26 WEST OF THE 5TH P.M., CITY OF WAUKEE,
DALLAS COUNTY, IOWA BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID SECTION 6; THENCE ALONG THE
SOUTH LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 6 S84°13'58”W, 208.04
FEET TO THE POINT OF BEGINNING; THENCE CONTINUING ALONG SAID SOUTH LINE
S84°13'58”W, 1114.73 FEET TO THE SOUTHEAST CORNER OF PARCEL B AS RECORDED IN
DALLAS COUNTY RECORDS IN BOOK 1998, PAGE 360; THENCE ALONG THE EAST LINE
OF SAID PARCEL B N00°21'36”E, 914.90 FEET; THENCE S89°45'02”E, 144.97 FEET; THENCE
S00°14'58”W, 32.50 FEET; THENCE S89°45'02”E, 242.42 FEET; THENCE N05°08'16”E, 33.03
FEET; THENCE S79°39'53”E, 141.25 FEET; THENCE S10°20'07”W, 22.50 FEET; THENCE

DESCRIBED AREA CONTAINS 22.20 ACRES, WHICH INCLUDES 1.17 ACRES OF PUBLIC
ROAD EASEMENT. DESCRIBED AREA IS SUBJECT TO EASEMENTS AND RESTRICTIONS
OF RECORD.
SAID PARCEL TO BE REFERRED TO AS DAYBREAK PLAT 2
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as
a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.
