AGENDA ITEM: Consideration of approval of a resolution approving Preannexation Agreement
dated May 1, 2017
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The subject property is a large parcel of unincorporated
area that is adjacent to the Waukee city limits. The approximate 1,100-acre
parcel lies west of County Road R-22 and south of Interstate 80. The parcel is
part of the 2008 comprehensive plan and is included in the area being planned
in the City’s current comprehensive planning process with input from the
Property Owner.
The City annexed a portion of the property not previously restricted under the
prior annexation moratorium agreement with West Des Moines. This parcel
represents the remaining contiguous land currently owned by Ruan. A pre-
annexation agreement was prepared that outlines a framework for providing
municipal services to the property and that aligns with the property owner’s
future plans for the land. The Property is currently served by Waukee Fire
and EMS services and law enforcement will be extended upon the completion
of the annexation process. The City is planning the extension of water across
the interstate and has already extended gas to a point near the northern
property line of Ruan’s property that was previously annexed to the City. The
proposed agreement addresses further the extension of the gas and water
utilities to serve the additional property following annexation as well as future
sanitary sewer development. The proposed pre annexation agreement is
largely consistent with the pre annexation agreement involving the previous
annexation of the contiguous Ruan property.

STAFF REVIEW AND COMMENT: City staff recommends City Council approval of the pre-
annexation agreement with the property owner.
RECOMMENDATION: Approve the resolution.

APPROVING PREANNEXATION AGREEMENT
DATED MAY 1, 2017
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Ruan, Inc., submitted a preannexation agreement and application for voluntary
annexation seeking Council approval of the annexation agreement and the Voluntary Annexation of
their property to the City; AND,
WHEREAS, the City Council having considered the preannexation agreement with Ruan, Inc., finds
that the same should be approved subject to the completion of the annexation of the property that is the
subject of said agreement.
BE IT THEREFORE RESOLVED that the preannexation agreement submitted for consideration by
the City Council of the City of Waukee and executed by the property owner Ruan, Inc., should be and
the same is hereby approved subject to completion of the annexation of the property that is the subject
of said agreement as contemplated therein.
Passed by the City Council of the City of Waukee, Iowa, and approved the 8th day of May, 2017.
