AGENDA ITEM: On an ordinance to amend Chapter 301, Zoning Ordinance, City of
Waukee, Iowa by rezoning and changing certain property therein from
R-4/PD11 (Rowhouse and Townhome Dwelling District)/(Planned
Development Overlay) to C-1/PD-1 (Community and Highway Service
Commercial District)/(Planned Development Overlay), a parcel to be
known as Williams Pointe Plat 13, Lot 1 [Public Hearing]

SYNOPSIS INCLUDING PRO & CON: The applicant, Topsoil Farms, LLC is requesting
approval of a rezoning of approximately 4.77 acres of property from R-
4/PD-1 to C-1/PD-1. The property is located at the northwest corner of
SE Brick Drive and SE Laurel Street. The property along with the
property directly to the north had previously been zoned C-1 Community
and Highway Commercial until 2013 when it was rezoned to
accommodate a townhome developer. The property has never been
developed. Last year, the City Council rezoned the property directly to
the north to C-1 Community and Highway Commercial to accommodate
a self-storage development.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the proposed request on May 9, 2017 and
recommended approval.
Approval of a Rezoning related to a change from PD R-4 ( Planned Development Row
Dwelling and Townhome District) to PD C-1 ( planned Development Community and
Highway Service Commercial District) [ Williams Pointe North Planned Development]
City Planner, Melissa DeBoer, introduced the request for rezoning made by the applicant Top
Soil Farms US, LLC. The Subject property is generally located at the northwest corner of SE
Brick Drive and SE Laurel Street, containing approximately 4.77 Acres. Mrs. DeBoer advised
that the property was rezoned for townhomes in 2013, but has since been repurchased with the
intent for commercial development. The necessary petition and consent to the rezoning in order to
begin the rezoning process has been submitted by the applicant and notice of the rezoning was
sent on May 2, 2017. To date the staff has not received any formal correspondence for or against
the proposed rezoning. Mrs. DeBoer advised that Staff feels that the R-4 current zoning is out of
place with the surrounding projects and land use and would recommend approval of the
Rezoning.
Commissioner Streit clarified that the property was just being reverted back to the C-1
designation that it held prior to 2013. Mrs. DeBoer clarified that was correct.
Tim West of Snyder and Associates, a representative of the Applicant, advised that they
were looking at some general commercial development and had gathered the consent of
surrounding property owners.
Commissioner Schmidt questioned if the Staff had received the full 50% consent and
Mrs. DeBoer advised that the 50% requirement had been met.
Commissioner Schmidt moved to approve a rezoning related to a change from PD R-4 (
Planned Development Row Dwelling and Townhome District) to PD C-1 ( Planned
Development Community and Highway Service Commercial District) [ Williams Pointe
North Planned Development] subject to all remaining staff comments and review of legal
documents. The motion was seconded by Commissioner Streit. Ayes: Streit, Broderick,
Hoifeldt and Schmidt. Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: Staff believes the proposed rezoning is consistent with
the surrounding land use and the original intent of the Williams Pointe
North Development.
RECOMMENDATION: Hold the public hearing.

BACKGROUND:
The subject property is included in the Williams Pointe Planned Development that was approved by the City of Waukee
in July 2005 and amended several times over the years, most recently for the development of townhomes at the
intersection of SE Waco Place and SE Laurel Street. The Planned Development includes a total of 104 acres more or
less and includes single family homes, townhomes, condominiums/apartments and commercial development when it is
fully developed. The property in question has previously been platted as a part of Williams Pointe Plat 13 and was
rezoned in 2013 for townhomes from C-1 Commercial. The townhome project never moved forward, the property
went back to the FDIC and was recently purchased. The current owner is requesting the property be rezoned back to
C-1 Community and Highway Commercial with a Planned Development Overlay, consistent with what the property was
zoned prior to 2013.

PROJECT DESCRIPTION:
The applicant has submitted the necessary petition and consent to the rezoning in order to begin the rezoning
process. Notification of the proposed rezoning request was sent on May 2, 2017. To date, staff has not
received any formal correspondence for or against the proposed rezoning request. Notification signs of the
proposed planned development change have been erected on the properties specific to the underlying zoning
designation proposed. The signs also identify the City Council Public Hearing Date of May 15, 2017.

The property located just to the north of the subject property was rezoned earlier this year to accommodate
a self-storage development. Between the development of the property to the north and the existing light
industrial development to the west, staff does feel that the current zoning of the property is inconsistent with
the surrounding area.
STAFF RECOMMENDATION
With the changing uses of the surrounding development, staff feels the rezoning of the property back to C-1
Community and Highway Commercial is appropriate and is consistent with the past zoning of the property.
Staff would recommend approval of the proposed rezoning.
