The May 4th, 2017 Board of Adjustment meeting was called to order at 5:30P.M by Chairman Doug Drees. Roll Call. The Chair asked for a roll call and the following Board Members were present: Myers, Breckenridge, and Drees. Absent: Members Garcia and Irvin. City Staff in attendance: Melissa DeBoer and Kathryn Purvis. Applicants in attendance: Kyle Panos and Megan Lukes of 215 Linen Drive. Approve the May 4th, 2017 Agenda. Board Member Myers made a motion, seconded by Board Member Breckenridge, to approve the agenda for May 4th, 2017 with the amendment of moving item 5 the election of officers to after item 6 the application for variance. Ayes: Myers, Breckenridge, and Drees. Nays: None. Motion carried. Approve the February 16th, 2017 Board of Adjustment Minutes. Board Member Breckenridge made a motion, seconded by Board Member Myers, to approve the Board of Adjustment meeting minutes for February 16th, 2017. Ayes: Myers, Breckenridge, and Drees. Nays: None. Motion carried. Application for 215 Linden Drive (Windfield plat 3 lot 40) – Variance from 301.8 (M) of the Waukee Municipal Code to allow a 6 foot tall fence to be placed within the required 30 foot Building Set Back Line. City Planner Melissa DeBoer introduced the request stating the property was addressed as 215 Linden Drive and located at the southeast corner of the intersection of Linden Drive and Windfield Parkway backing up to Warrior Lane. Mrs. DeBoer advised the variance, if approved, would allow the applicant to place a 6 foot tall fence in the location of the current fencing portion that stands at 3.5 feet tall. At this time staff has not received any correspondence from the surrounding property owners after mailing out notices of the variance request on April 24th, 2017. The Applicants explain that the current 3.5 foot fence provides virtually no privacy protection, which makes it hard to relax and enjoy their backyard deck and patio. The applicants have noted that their property is a triple frontage lot with high traffic at all hours of the day and night resulting in a safety concern as well. Finally, the applicants noted that it will not result in injury or endangerment to other property or persons, and it will not devalue nearby property by installing a 6 foot fence.  Board Member Drees commented that it did not seem like a 6 foot fence would create a sight hazard.  Board Member Breckenridge advised that he could see how the privacy on the corner lot was a concern seeing as he drove past the subject property and had direct site lines into the home and yard.  Board Member Myers questioned why the 3 foot fence was installed. Board Member Drees suggested that, as other areas in the neighborhood had 6 foot fences, there might have been an ordinance change. Mrs. DeBoer advised that there had not been a change as far back as she could find, but that it was an older part of town.  Applicant Megan Lukes reiterated the concerns for privacy and safety being the main reason for the request, stating that the corner is always busy at all hours of the night and day, and that she would like to not have drivers be able to glance directly into her back yard and home. Board Member Myers moved to approve a variance from 301.8(M) of the Waukee Municipal Code to allow a 6 foot tall fence to be placed within the required 30 foot building set back line. The motion was seconded by Board Member Breckenridge. Ayes: Myers, Breckenridge, and Drees. Nays: None. Motion carried. Old Business City Planner Melissa DeBoer advised there was no carry over business from previous meetings. New Business City Planner Melissa DeBoer advised there were currently no new applications. Adjournment Adjournment of the May 4th, 2017 Planning and Zoning Commission Meeting was motioned by Board Member Breckenridge and seconded by Board Member Myers at 5:37 pm. Ayes: Myers, Breckenridge, and Drees. Nays: None.
