The area residents have petitioned the City to lower the speed limit to 25 mph due to concerns with handicap residents crossing the street. After review Public Works and Public Safety recommend lowering the speed limit from 30 mph to 25 mph in that area. WHEREAS, the City of Waukee has determined that a new speed limit shall be implemented on certain portions of Legacy Pointe Boulevard within the City of Waukee. BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1: Chapter 501, Waukee Municipal Code, Regulation of Traffic Upon and Use of the Streets of Waukee, Iowa, is hereby amended by changing the following Section 501.9(F)(11): §501.9(F)(11) The speed limit on Legacy Pointe Boulevard, from the south line of US Highway 6 to just north of Laurel Street, shall be 25 miles per hour. Section 2 Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law. This Ordnance setting the speed limit to 30 mph, #2633, was adopted on June 16, 2008. This area is a residential retirement community and is increasingly becoming very dangerous as many exceed the speed limit of 30 mph. Many handicapped citizens use this area on foot. In addition, visibility is restricted for drivers entering SE Legacy Pointe Blvd from SE Golden Harvest Drive due to construction of new homes on the corner/curve of SE Legacy Pointe Blvd. Also, many east and south -bound drivers fail to obey the stop sign at this intersection.
