RESOLUTION 17-
A RESOLUTION AUTHORIZING THE DISPOSAL OF REAL ESTATE IN
ACCORDANCE WITH IOWA CODE 364.7(2017)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the City caused notice of a public hearing to be published in accordance with Iowa
Code 364.7 Code of Iowa (2017) concerning the disposal of certain real estate owned by the City
to the Waukee Community School District; AND
WHEREAS, on June 5, 2017, the Waukee City Council held a public hearing pursuant to Iowa
Code §364.7 regarding the sale of property legally described as:
The Southwest Quarter of the Northwest Quarter of Section 28, Township 79
North, Range 26 West of the 5th P.M., City of Waukee, Dallas County, Iowa, and;
The Northwest Quarter of Northwest Quarter (NW 1/4 NW 1/4) in Section 28,
Township 79 North, Range 26 West of the 5th P.M. in Dallas County, Iowa;
EXCEPT Roadway and EXCEPT Parcel "A" of a Plat of Survey of the South Half
of Northwest Quarter of Northwest Quarter (S 1/2 NW 1/4 NW 1/4) in Section
28, Township 79 North, Range 26 West of the 5th P.M., Dallas County, Iowa, as
recorded in the Office of the Dallas County Recorder dated July 18, 2007, Book
2007, Page 1136, subject to easements and restrictions of record.
Parcel "A" as described in the Plat of Survey of the South Half of Northwest
Quarter of Northwest Quarter (S 1/2 NW ¼ NW 1/4) in Section 28, Township 79
North, Range 26 West of the 5th P.M., Dallas County, Iowa, as recorded in the
Office of the Dallas County Recorder dated July 18, 2007, Book 2007, Page 1136,
subject to easements and restrictions of record.
The West 55.0 feet of the South 424.0 Feet and the West 40.0 feet of the North
296.0 feet of the South 720.0 feet and the West 55.0 feet of the North 597.0 feet,
all in the Northwest Quarter of the Northwest Quarter (NW 1/4 NW 1/4) of
Section 28, Township 79 North, Range 26 West of the 5th P.M., Dallas County,
Iowa containing 0.45 acres more or less, exclusive of present established
highways and subject to all easements and restrictions of record.
WHEREAS, after the public hearing, and consideration of the proposal concerning the disposal
of said real estate to the Waukee Community School District, a public body as contemplated by
364.7 Code of Iowa, as previously provided in the 28E agreement between the City and the
Waukee Community School District entered into for the purpose of the acquisition of the land
being disposed of hereunder, and other good and valuable consideration from said school district,
the City Council of the City of Waukee determines that it is in the best interest of the City to
authorize the disposal of said property to the School District.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
5th day of June, 2017, that, following public hearing as required by Iowa Code 364.7 Code of
Iowa (2015), hereby approves the disposal of property to the Waukee Community School
District legally described as:
The Southwest Quarter of the Northwest Quarter of Section 28, Township 79
North, Range 26 West of the 5th P.M., City of Waukee, Dallas County, Iowa, and;
The Northwest Quarter of Northwest Quarter (NW 1/4 NW 1/4) in Section 28,
Township 79 North, Range 26 West of the 5th P.M. in Dallas County, Iowa;
