WAUKEE CITY COUNCIL MINUTES
June 5, 2017
(The council followed the agenda in a different order than posted.)
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Peard
at 5:32 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor William F. Peard; Council Members Brian
Harrison, Shelly Hughes, Larry R. Lyon. Absent: Council Members Anna Bergman, R. Charles
Bottenberg. (Council Member Bottenberg arrived at 5:34 p.m.; Council Member Bergman arrived at
5:51 p.m.)
Also present: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public Works
Director John Gibson, Development Services Director Brad Deets, Community and Economic
Development Director Dan Dutcher, Marketing and Communications Director Summer Evans, Fire

(D) Open Forum
(E) Agenda Approval – Council Member Lyon moved to approve the agenda with the following
changes: remove items G2 and G3; reorder the agenda to move items H4, I4A and I4B to
immediately follow item G1; table items J1T and J1U until the July 10, 2017 regular meeting; and
correct item J1X to read July 10, 2017 as the date of a public hearing instead of June 5, 2017 as
posted; seconded by Council Member Hughes. Results of vote: Ayes: Harrison, Hughes, Lyon.
Nays: None. Absent: Bergman, Bottenberg. Motion carried 3 – 0 – 2. (Council Member Bottenberg
arrived at 5:34 p.m.)
(F) Mayor’s Report – Mayor Peard praised the Celebrate Waukee festival organizers for a successful
event. BACooN Sizzles Waukee will be 06/16. The U.S. Census Bureau announced new population
numbers for Waukee of 19,284.
(G) Presentations:
1) Bravo Greater Des Moines annual report – Report made by Bravo Greater Des Moines
Community Impact Specialist Rachel Woodhouse.

(H) Public Hearings:
*4) On the annexation of consenting properties by the City of Waukee, Iowa, with
consideration of the annexation taking place immediately thereafter [Waukee West] –
Mayor Peard opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Development Services Director Deets stated
that several property owners have submitted annexation petitions to the City, as they have been
approached by developers over the years and the property owners see an advantage to
annexation into the City. The City has several public utility projects either under construction or
in the planning stages that will service the subject area. The proposed annexation is 100%
voluntary. No comments were made by the public present.
Public Hearing Action Items:
**4) Annexation – Waukee West
A. Resolution: Consideration of approval of a resolution approving Pre-annexation
Agreements associated with the Waukee West Annexation – Council Member Lyon
moved to approve the resolution; seconded by Council Member Harrison. Development
Services Director Deets noted three property owners who have requested a pre-annexation
agreement. Results of vote: Ayes: Bottenberg, Harrison, Hughes, Lyon. Nays: None.
Absent: Bergman. Motion carried 4 – 0 – 1. (Resolution #17-254)

B. Resolution: Consideration of approval of a resolution approving the annexation of
consenting properties by the City of Waukee, Iowa [Waukee West] – Council Member
Harrison moved to approve the resolution; seconded by Council Member Lyon. Development
Services Director Deets stated that the annexation application, if approved, would likely be
considered by the City Development Board at their July 2017 meeting. Results of vote: Ayes:
Bottenberg, Harrison, Hughes, Lyon. Nays: None. Absent: Bergman. Motion carried 4 – 0 –

(H) Public Hearings, Continued:
1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 to K-RR, a property to be known as Ashworth East–
(Council Member Bergman arrived at 5:51 p.m.) Mayor Peard opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets briefly reviewed the rezoning application, noting
the types of development allowed in the K-RR district. The zoning is consistent with the
Kettlestone Master Plan. Regarding a concern with increased traffic that was discussed at the
Planning & Zoning Commission meeting, Mr. Deets noted that such concerns would be
addressed as part of the development process. Mayor Peard invited public comment on the
matter: 1) Denny Dolmage, 3273 Ashworth Rd., explained his concerns regarding increased
traffic, as Ashworth Rd. is currently a two-lane road with no turn lanes and has already seen a
marked increase in traffic since the opening of Grand Prairie Pkwy. He is not opposed to the
development, but believes that Ashworth Rd. must be improved to handle traffic increases. City
Administrator Moerman replied that Ashworth Rd. improvements will be considered. Mr.
Dolmage asked if the council would commit to Ashworth Rd. being widened prior to the
development of the subject property; Mr. Moerman answered that such matters are addressed as
development occurs and that it is also in the City’s best interest to improve Ashworth Rd.
2) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning and amending certain property from R-3/PD-1 to R-3/PD-1, a property known as
Landing at Shadow Creek Plat 2, Outlot Z – Mayor Peard opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied that two
letters in opposition to the rezoning application were included in the agenda packet.
Development Services Director Deets briefly reviewed the rezoning application, which would
amend the PD-1 overlay. The rezoning would allow for greater density and structure height, with
one large building containing all residential units instead of multiple smaller buildings as was
initiailly proposed for the subject parcel. The current proposal would allow for a maximum of 20
units per acre and a four-story, flat roofed building. In exchange for the PD-1 allowance, the
developer proposes substantial indoor and outdoor amenities for the project residents. At the
Planning & Zoning Commission meeting, there was much discussion regarding neighbor
concerns with the proposed building height. The Commission recommended limiting the building
height to 45 feet; the applicant continues to request a 50-foot maximum height allowance.
Bradley Haverkamp of Haverkamp Properties, rezoning applicant, addressed the council and
referenced a letter from his company in the agenda packet that outlined their response to the
building height concerns. Council Member Hughes asked about building setbacks and
landscape buffers; Mr. Deets reviewed the minimum requirements, noting additional landscaping
and berming that would be part of the project. Council Member Hughes asked for clarification on
overall building height differences between a flat and pitched roof; Mr. Deets noted an
approximate 10-foot difference. Council Member Bottenberg asked if the project would have
access from Alice’s Road; Mr. Deets replied in the affirmative. No comments were made by the
public present.
3) On a proposed land transfer to the Waukee Community School District pursuant to the
terms of a 28E Agreement – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets briefly reviewed the land transfer, which would fulfill one of the
requirements of a previously-approved 28E agreement with the school district. No comments
were made by the public present.

Business Park] – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets noted that the proposed annexation was 100% voluntary, stating that
three specific properties were included in order to avoid creating an island. He also reviewed
sanitary sewer infrastructure plans that would provide services to the subject properties. No
comments were made by the public present.
6) On plans, specifications, form of contract and estimate of cost [Grand Prairie Parkway and
SE Esker Ridge Drive Traffic Signal Improvement Project] – Mayor Peard opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett replied in
the negative. Public Works Director Gibson briefly reviewed the project. No comments were
made by the public present.
7) On plans, specifications, form of contract and estimate of cost [2017 Asphalt Overlay
Project] – Mayor Peard opened the public hearing and asked if any written correspondence had
been received; City Clerk Schuett replied in the negative. Public Works Director Gibson briefly
reviewed the project, as well as past asphalt overlay projects in this area of the city. No
comments were made by the public present.
8) On plans, specifications, form of contract and estimate of cost [Kettlestone Greenway
Improvements Project Phase 1] – Mayor Peard opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative.
Development Services Director Deets briefly reviewed the project. No comments were made by
the public present.

Member Lyon moved to approve the resolution; seconded by Council Member Bergman.
Public Works Director Gibson reviewed the bid tabulation and project schedule,
recommending award of the contract to Iowa Signal, Inc., of Grimes, IA, in the amount of
$349,462.50. Results of vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays:
None. Motion carried 5 – 0. (Resolution #17-260)
C. Resolution: Consideration of approval of a resolution approving contract, bond –
Council Member Bergman moved to approve the resolution; seconded by Council Member

7) 2017 Asphalt Overlay Project
A. Resolution: Consideration of approval of a resolution approving plans, specifications,
form of contract and estimate of cost – Council Member Bergman moved to approve the
resolution; seconded by Council Member Lyon. Public Works Director Gibson briefly
reviewed the bid tabulation, recommending award of both the base bid and alternate to Paco
Construction of Runnells, IA, in the amount of $162,652.40. City Administrator Moerman
added that the project was part of the council’s continued investment in the Original Waukee
neighborhood. Results of vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays:
None. Motion carried 5 – 0. (Resolution #17-262)
B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Lyon moved to approve the resolution; seconded by Council Member Bottenberg.

a property known as Williams Pointe Plat 13, Lot 1 [second reading] – Council Member
Bergman moved to approve the second reading of the ordinance in title only; seconded by
Council Member Harrison. Results of vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon.
Nays: None. Motion carried 5 – 0.
3) Ordinance: Consideration of approval of an ordinance amending Chapter 501, Waukee
Municipal Code, regarding the speed limit on SE Legacy Pointe Boulevard within the city
limits of the City of Waukee, Iowa [second reading] – Council Member Bottenberg moved to
approve the second reading of the ordinance in title only; seconded by Council Member Hughes.
Results of vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays: None. Motion
carried 5 – 0.
4) Ordinance: Consideration of approval of an ordinance amending Chapter 501, Waukee
Municipal Code, regarding the speed limit on SE Westown Parkway within the city limits of
the City of Waukee, Iowa [second reading] – Council Member Harrison moved to approve the
second reading of the ordinance in title only; seconded by Council Member Bergman. Results of
vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays: None. Motion carried 5 – 0.
5) Resolution: Consideration of approval of a resolution approving site plat for Bricktowne
Waukee Central [420 SE Laurel Street] – Council Member Bergman moved to approve the
resolution; seconded by Council Member Lyon. Development Services Director Deets briefly
reviewed the site plan, including amenities, which is consistent with previously-approved zoning.
Council Member Lyon asked if the project was the same as initially approved; Mr. Deets clarified
that the project was the same as the modified plan. Results of vote: Ayes: Bergman, Bottenberg,
Harrison, Hughes, Lyon. Nays: None. Motion carried 5 – 0. (Resolution #17-279)
(K) Reports – Reports made by City Administrator Moerman, Council Member Bergman.
At this time, Justin Washburn, seller of a property at 1060 SE Grant Woods Ct., addressed the
council and asked for future consideration of a request to remove a landscape buffer at that property.
City Administrator Moerman stated that staff would provide a report on the matter to the council and
would add Mr. Washburn’s request to an upcoming council agenda.
(L) Closed Session: Pursuant to Code of Iowa §21.5(1)(c) to discuss strategy with counsel in
matters that are presently in litigation or where litigation is imminent where its disclosure
would be likely to prejudice or disadvantage the position of the governmental body in that
litigation – Council Member Lyon moved to close the regular session and enter closed session
pursuant to Iowa Code §21.5(1)(c); seconded by Council Member Harrison. Results of vote: Ayes:
Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays: None. Motion carried 5 – 0. Council entered
closed session at 6:38 p.m.
