HomeMy WebLinkAbout2017-07-10-J08 Fox Creek Estates Plat 9_Final Plat AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: July 10, 2017 AGENDA ITEM: Consideration of approval of a resolution approving a final plat for Fox Creek Estates Plat 9 FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The applicants, TCB Investments LLC and Waukee Lots LLC are requesting approval of a final plat for approximately 12 acres. The property is generally located north of Douglas Parkway and east of Warrior Lane. The final plat includes a total of 32 single family lots and is a continuation of the Fox Creek Estates Development. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed this project at the May 23, 2017 Commission Meeting and recommended approval subject to remaining staff comments: Approval of a Final Plat for Fox Creek Estates Plat 9 Senior Planner Andy Kass introduced the request for final plat approval made by the applicant Fox creek Waukee, LLC & Landing at Shadow Creek, LLC. The subject property is generally located east of Warrior lane and North of NE Douglas Parkway, and is approximately 12 acres. The property was rezoned in 2016 from A-1 to R-2 and a portion of the property was brought into the City by a 2016 annexation. Mr. Kass explained that the final plat identifies 32 Single Family lots ranging from 9,334 square feet to 26,113 square feet in size and range in depths to accommodate the creek and woodland area. Several lots will have an out lot to accommodate a mapped flood plain. The out lots are not buildable and cannot be sold separate of the lot they correspond to. Mr. Kass advised 2 streets will be extended, NE Badger Lane and NE Bobcat Drive. Five foot sidewalks will be constructed as lots develop, and all utilities will be extended to all lots. Parkland dedication is satisfied with the Fox Creek Estates Plat 4 approval, and storm water will be maintained in the Fox Creek Estates Plat 6 basin and maintained by the resident Homeowners Association. Commissioner Streit questioned if there were any significant changes from the preliminary plat to the final. Mr. Kass advised that there had not been any significant changes. Commissioner Schmidt questioned if NE Badger lane would end in Clive. Mr. Kass advised that the ending of NE Badger Lane would be part of the next motion. Above this area was the old corporate limits for the City of Waukee. Both the City of Waukee and City of Clive agreed to annex specific locations in this area to provide a cleaner cut off between the corporate limits. Commissioner Streit moved to approve the final plat for Fox Cree Estates Plat 9. The motion was seconded by Commissioner Shanks. Ayes: Stonebrook, Streit, Broderick, Hoifeldt, Shanks, and Schmidt. Nays: None. Motion Carries. STAFF REVIEW AND COMMENT: At this time, there are some minor punchlist items outstanding related to the public improvements within the plat. The developer has provided the necessary cash bond related to the outstanding improvements. RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Proposed Resolution II. Staff Report III. Final Plat PREPARED BY: Brad Deets, Development Services Director REVIEWED BY: THE CITY OF WAUKEE, IOWA RESOLUTION 17- APPROVING THE FINAL PLAT FOR FOX CREEK ESTATES PLAT 9 IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, TCB Investments LLC and Waukee Lots, LLC, have requested final approval of Fox Creek Estates Plat 9 (the “Plat”); AND WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat on May 23, 2017, subject to remaining staff comments and review of the legal documents; AND, WHEREAS, the Final Plat for Fox Creek Estates Plat 9 and the documents relating thereto will comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this 10th day of July, 2017, that the Final Plat for Fox Creek Estates Plat 9 be and the same is hereby accepted and approved by the City Council of the City of Waukee. BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements and documents to be filed with the Plat: 1. Warranty Deed (City Streets); 2. Partial Release of Development Agreement (Parkland Dedication); 3. Sanitary Sewer Easement; 4. Public Utility Easement; 5. Public Storm Sewer Easement (2); 6. Lyon STAFF REPORT TO: Planning and Zoning Commission PREPARED BY: Andy Kass RE: Fox Creek Estates Plat 9 – Final Plat DATE: May 23, 2017 GENERAL INFORMATION: Applicant: Fox Creek Waukee, LLC & Landing at Shadow Creek, LLC Requested Action Final Plat Approval Location and Size: Property is generally located east of Warrior Lane and north of NE Douglas Parkway, containing approximately 12 acres. The proposed plat is the ninth phase of the Fox Creek Estates development. The property was rezoned in 2016 from A-1 to R-2. In addition, a portion of this property was annexed into the City of Waukee in 2016. May 19, 2017 2 of 3 ABOVE: Aerial Photo of Proposed Plat outlined in RED in relation to the surrounding properties Project Description: Lots: The final plat identifies a total of 32 single family lots that are in similar shape and size to adjacent residential lots. The proposed lots range in size from 9,334 square feet to 26,113 square feet. The minimum lot size in the R-2 district is 8,000 square feet. The lot widths range in size from 68 feet to 88 feet. The minimum lot width in the R-2 district is 65 feet. Lots 13 – 16 are particularly deep to accommodate the creek and woodland area that exists on the backside of the lots. Some of these lots are within the mapped floodplain which is why there are outlots indicated on the rear of some of the lots. These outlots will not be buildable and can only be sold with the respective buildable lot that they correspond to. Streets: The developer is in the process of constructing the public streets for this plat. NE Badger Lane will be extended from the south to the north. NE Bobcat Drive will be extended from the east to the west. Both streets are local streets that will be 29 feet wide and have 60 feet of right-of-way. Five foot sidewalks will be constructed on both sides of the streets as the individual lots develop. Easements: Several easements are proposed within the plat based upon the location of proposed utilities. May 19, 2017 3 of 3 Utilities: Sanitary sewer, storm sewer, and water main have been extended throughout the plat as part of the public improvements. In addition, sanitary, storm, and water services will be provided to each lot. Parkland Dedication: Parkland dedication for this plat has been satisfied with the approval of Fox Creek Estates Plat 4. STAFF RECOMMENDATION At this time Staff feels comfortable with the proposal and would recommend approval of the Final Plat for Fox Creek Estates Plat 9 subject to remaining staff comments, review of the legal documents by the City Attorney, and completion of public improvements.
