HomeMy WebLinkAbout2017-07-10-J09 Fox Creek Estates Plat 10_Final Plat AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: July 10, 2017 AGENDA ITEM: Consideration of approval of a resolution approving a final plat for Fox Creek Estates Plat 10 FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The applicant, Waukee Lots LLC, is requesting approval of a final plat for approximately 11 acres. The property is generally located north of Douglas Parkway and east of Warrior Lane. The final plat includes a total of 18 single family lots and is a continuation of the Fox Creek Estates Development. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed this project at the May 23, 2017 Commission Meeting and recommended approval subject to remaining staff comments: Approval of a Final plat for Fox Creek Estates Plat 10 Senior Planner Andy Kass introduced the request for final plat approval made by the applicant Waukee Lots, LLC. The subject property is generally located east of Warrior Lane and north of NE Douglas Parkway, and is approximately 11.24 acres. This property was recently annexed into the City of Waukee and rezoned from A-1 to R-2. Mr. Kass explained that the final plat identifies 18 single family lots ranging in size from 12,122 square feet to 56,147 square feet. Several lots contain out lots to accommodate a mapped flood plain. These out lots are not buildable and cannot be sold separate of the lot they correspond to. Mr. Kass advised 2 streets will be extended, NE Badger Lane and NE Fox Valley Court, before ending in a cul-de-sac. Five foot sidewalks will be constructed as lots develop, and all utilities will be extended to all lots. Parkland dedication is satisfied with the Fox Creek Estates Plat 4 approval, and storm water will be maintained in the Fox Creek Estates Plat 6 basin and maintained by the resident Homeowners Association. Commissioner Schmidt moved to approve the Final Plat for Fox Creek Estates Plat 10. The Motion was seconded by Commissioner Streit. Ayes: Stonebrook, Streit, Broderick, Hoifeldt, Shanks, and Schmidt. Nays: None. Motion Carries. STAFF REVIEW AND COMMENT: At this time, there are some minor punchlist items outstanding related to the public improvements within the plat. The developer has provided the necessary cash bond related to the outstanding improvements. RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Proposed Resolution II. Staff Report III. Final Plat PREPARED BY: Brad Deets, Development Services Director REVIEWED BY: THE CITY OF WAUKEE, IOWA RESOLUTION 17- APPROVING THE FINAL PLAT FOR FOX CREEK ESTATES PLAT 10 IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, Waukee Lots, LLC, have requested final approval of Fox Creek Estates Plat 10 (the “Plat”); AND WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat on May 23, 2017, subject to remaining staff comments and review of the legal documents; AND, WHEREAS, the Final Plat for Fox Creek Estates Plat 10 and the documents relating thereto will comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this 10th day of July, 2017, that the Final Plat for Fox Creek Estates Plat 10 be and the same is hereby accepted and approved by the City Council of the City of Waukee. BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements and documents to be filed with the Plat: 1. Warranty Deed (City Streets); 2. Storm Water Management Facility Maintenance Covenant; 3. Public Water Main Easement; 4. Public Sanitary Sewer Easement; 5. Public Utility Easement; 6. Public Storm Sewer Easement; 7. The subject property was recently annexed into the City of Waukee and rezoned not long after incorporating into Waukee. May 19, 2017 2 of 3 ABOVE: Aerial Photo of Proposed Plat outlined in RED in relation to the surrounding properties Project Description: Lots: The final plat identifies a total of 18 single family lots. The proposed lots range in size from 12,122 square feet to 56,147 square feet. The minimum lot size in the R-2 district is 8,000 square feet. The lot widths range in size from 65 feet to 90 feet. The minimum lot width in the R-2 district is 65 feet. Some of these lots are within the mapped floodplain which is why there are outlots indicated on the rear of some of the lots. These outlots will not be buildable and can only be sold with the respective buildable lot that they correspond to. Streets: The developer is in the process of constructing the public streets for this plat. NE Badger Lane will be extended from the south to the north and end in a cul-de-sac. NE Fox Valley Court will be extended from the south to the north and end in a cul-de-sac. Both streets are local streets that will be 29 feet wide and have 60 feet of right-of-way. Five foot sidewalks will be constructed on both sides of the streets as the individual lots develop. Easements: Several easements are proposed within the plat based upon the location of proposed utilities. Utilities: Sanitary sewer, storm sewer, and water main have been extended throughout the plat as part of the public improvements. In addition, sanitary, storm, and water services will be provided to each lot. May 19, 2017 3 of 3 Parkland Dedication: Parkland dedication for this plat was previously satisfied. STAFF RECOMMENDATION At this time Staff feels comfortable with the proposal and would recommend approval of the Final Plat for Fox Creek Estates Plat 10 subject to remaining staff comments, review of the legal documents by the City Attorney, and completion of public improvements.
