AGENDA ITEM: Resolution Authoring the Delivery of a Notice of Intent to Purchase – Xenia
Rural Water District (western annexation)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: On July 12, 2017, the City Development Board took action
on the 3,500 annexation of property located west of the current Waukee City
Limits on either side of Hickman Road (Highway 6). It is anticipated that the
annexation will be completed and filed within 30 days.
The City of Waukee has an agreement with Xenia Rural Water District to
purchase the infrastructure from the District as the City continues to grow and
expand through annexation.
The attached resolution authorizes the notice to be sent to Xenia Rural Water
District regarding the City’s intent to purchase the existing water district
infrastructure within the annexation area.

RESOLUTION 17-
AUTHORIZING THE DELIVERY OF A NOTICE OF INTENT TO PURCHASE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND
WHEREAS, the City of Waukee entered into a Two-Mile Agreement Xenia Rural Water dated
July 20, 1992 and recorded in Book 728 Page 788 at the Dallas County Recorder’s Office; AND
WHEREAS, the City recently annexed an area of land on either side of US Highway 6 more
particularly depicted on the map attached to the notice of intent attached hereto; AND
WHEREAS, pursuant to the terms of the Agreement the City of Waukee has the option to
purchase property from Xenia in accordance with the terms of the Two-Mile Agreement by
delivering a notice of intent to do so in accordance therewith; AND
WHEREAS, the City of Waukee desires to purchase property in accordance with the Two-Mile
Agreement pursuant to said agreement;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that approval is
given to deliver a notice of intent to purchase, attached hereto, to Xenia Rural Water.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 17th day of July,
2017.
