WAUKEE CITY COUNCIL MINUTES
July 10, 2017
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Peard
at 5:32 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor William F. Peard, Council Members Anna
Bergman, R. Charles Bottenberg, Brian Harrison, Shelly Hughes, Larry R. Lyon. Absent: None

(E) Agenda Approval – Council Member Harrison moved to approve the agenda, removing item J3 from
consideration; seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg,
Harrison, Hughes, Lyon. Nays: None. Motion carried 5 – 0.
(F) Mayor’s Report – Mayor Peard thanked the Park Board and Parks and Recreation Department for
their work on the 07/04 celebration. Public Safety Day is 08/01. The Animal Rescue League is
offering incentives as part of the Home Base Iowa initiative. Fiscal Year 2017 building permit
numbers are very positive.

(H) Public Hearings:
1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning and amending certain property from C-4/PD-1 to R-3/PD-1, a parcel to be known
as Journey Senior Living – Mayor Peard opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett noted a petition included in the meeting
packets that is in opposition to the rezoning application. Development Services Director Deets
reviewed the previous zoning history of the parcel, noting that the current proposal was for a
senior living facility with 1- and 3-story components. In response to concerns discussed at the
Planning & Zoning Commission meeting, the applicant has modified the rezoning request to
increase the landscape buffer easement to 30 feet, conduct a tree survey to determine which
trees can remain, reduce parking areas and increase open space. The petition in opposition to
the application noted by Ms. Schuett, with an additional signature added following the Planning &
Zoning Commission meeting, represents more than 20% surrounding property area. As a result,
approval of the rezoning ordinance would require a super majority (4/5) vote of the council in
accordance with State law. Mr. Deets added that an existing pond feature on the subject
property will be retained and improved as needed to address storm water drainage. Eric Cannon
with Snyder & Associates, project engineer, addressed the council to note that neighbor
concerns regarding trees had been taken into consideration by the developer. The developer
had held an earlier meeting with surrounding property owners regarding the project.
Modifications were made to the rezoning request following the Planning & Zoning Commission
meeting. Mr. Cannon stated that the project was a good fit for the neighborhood, as it was low
traffic with reasonable hours of operation. Council Member Lyon asked if the existing pond was
viable; Mr. Cannon replied that drainage issues would need investigation, but the pond will likely
remain and be enlarged. Council Member Lyon asked how the developer proposed to identify
trees for preservation; Mr. Cannon answered that the developer would try to maintain trees within
the 30-foot buffer, but will need to conduct a tree survey. Council Member Bergman echoed a

neighborhood concern regarding buffer density if mature trees are removed; Mr. Deets noted
minimum landscaping requirements within the City code. He added that due to the unique nature
of the subject property, interested persons would be invited to view marked trees following the
survey. Mayor Peard suggested a future council discussion on tree preservation policy if there
were concerns regarding landscape density. Council Member Lyon asked if the Planning &
Zoning Commission was unanimous in their recommendation to council; Mr. Deets replied in the
affirmative.
Mayor Peard invited public comment on the matter*: 1) Shawn Devlin, 1020 SE Bluegrass Ct.,
spoke on behalf of neighbors concerned that many existing trees would be marked as scrub or
ash trees that must be removed. The larger landscape buffer proposed by the developer will
allow for more trees to be saved, allowing for better concealment of the proposed structures.
While Mr. Devlin agreed that the project was suitable for the area, he expressed concern with the
overall size proposed for the structures. He asked that the developer consider moving the
structures more to the south of the property to allow more room for plantings and buffers. He
noted that the 30-foot landscape buffer would only include two of the three existing rows of trees.
Council Member Bergman asked if the developer would consider increasing the 30-foot
landscape buffer; Mr. Cannon stated that the buffer had been increased by the developer to meet
commercial and not residential standards and that a larger buffer would be detrimental to the
project. He added that there were no plans to remove all trees outside the 30-foot landscape
buffer area unless it was necessary for drainage and site planning. Council Member Harrison
asked if there were any plans for expansion of the structures; Omar Barrientos with SVPA
Architects, project designer, replied in the negative. Council Member Bergman requested that
City staff continue engaging with the neighbors during the tree survey process. Mayor Peard
noted that any scrub trees would need to be removed, which could change the character of the
parcel. Council Member Hughes asked for council notification on what trees were marked for
removal.
2) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning and changing certain property therein from PD-1/C-1A, PD-1/C-4, and C-4 to C-1,
a parcel to be known as Blue Grass Commons – Mayor Peard opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets presented on the application, including a brief
zoning history of the subject property. Nicole Neal of Civil Design Advantage (CDA), project
engineer, addressed the council and requested that the second and third readings of the
ordinance be waived. No comments were made by the public present.
*Upon request, Mayor Peard reopened the public hearing on the rezoning application for Journey
Senior Living. 1) Brad Irwin, 1275 SE University Ave. #205, spoke in favor of the application,
noting a general need for senior housing options. 2) Mark Christian, 1400 SE Rosewood Ct.,
stated that his backyard abutted the subject property and expressed concern with the proposed
3-story structure, noting that it would be difficult to obscure with trees. 3) Dave Tomlin, 1030 SE
Bluegrass Cir., echoed Mr. Devlin’s statements from the earlier public hearing, asking who would
have the final say on which trees are removed; Mayor Peard replied that the City would make
that determination. Mr. Tomlin then asked if removed trees would be replaced by larger new
trees, noting that smaller trees would not obscure the view as well. He also voiced concern
regarding a proposed walking path around the existing pond, as the path might be in close
proximity to his property; Mr. Deets replied that only plantings would be allowed within the 30-foot
landscape buffer. Mr. Tomlin then noted flooding issues on his property, asking how the
developer would address drainage issues.
3) On plans and specifications, form of contract and estimate of cost [Original Sanitary
Sewer Collection System Rehabilitation Project Phase 3] – Mayor Peard opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett replied in
the negative. Public Works Director Gibson presented on the project, including a map of
previous and future sewer rehabilitation projects. No comments were made by the public
present.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by rezoning and amending certain property from C-4/PD-

1 to R-3/PD-1, a parcel to be known as Journey Senior Living [introduction; first reading] –
Council Member Lyon introduced the ordinance and moved to approve the first reading in title
only; seconded by Council Member Hughes. Development Services Director Deets noted that he
had been a member of a metro-area committee that developed a model ordinance related to tree
preservation. The council agreed to discuss the model ordinance on 07/17. Results of vote:
Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays: None. Motion carried 5 – 0.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning
Ordinance, City of Waukee, Iowa, by rezoning and changing certain property therein from
PD-1/C-1A, PD-1/C-4, and C-4 to C-1, a parcel to be known as Blue Grass Commons
[introduction; first reading] – Council Member Bergman introduced the ordinance and moved
to approve the first reading in title only; seconded by Council Member Harrison. Development
Services Director Deets stated that he was previously unaware of the request to waive the
second and third readings, recommending that such waivers be considered by the council on
07/17. Results of vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays: None.
Motion carried 5 – 0.
3) Original Sanitary Sewer Collection System Rehabilitation Project Phase 3
A. Resolution: Consideration of approval of a resolution approving plans and
specifications, form of contract and estimate of cost – Council Member Lyon moved to
approve the resolution; seconded by Council Member Harrison. Results of vote: Ayes:
Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Bergman moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director Gibson briefly reviewed the bid tabulation and project schedule,
recommending award to SAK Construction, LLC, of O’Fallon, MO, in the amount of
$297,773.75. Results of vote: Ayes: Bergman, Bottenberg, Harrison, Hughes, Lyon. Nays:
None. Motion carried 5 – 0. (Resolution #17-311)

Member Hughes. Public Works Director Gibson briefly reviewed the change order for additional
manhole lining, noting an overall cost savings in including the project with Phase 2A
improvements instead of bidding the project separately. Council Member Lyon asked how the
lining would extend the lifespan of the manhole areas; Mr. Gibson replied it would likely add 40-

Member Lyon. Public Works Director Gibson briefly reviewed the change order, which includes
the relocation of an existing control building to a different project area and the purchase and
installation of a new control building for this particular project. The developer of the other project
(I-80 West Business Park) will reimburse the City for the control building relocation. Results of

A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Pro Tem
Bergman at 5:35 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Council Members Anna Bergman, R. Charles
Bottenberg, Brian Harrison, Shelly Hughes, Larry R. Lyon. Absent: Mayor William F. Peard. (Mayor

2) Resolution: Consideration of approval of a resolution authorizing the delivery of a notice of
intent to purchase – Xenia Rural Water District (western annexation) – Council Member Lyon
moved to approve the resolution; seconded by Council Member Bottenberg. Development
Services Director Deets noted that the notice of intent to purchase was a requirement of an
existing Two-Mile Agreement between Xenia Rural Water District and the City. The water
infrastructure for purchase serves the recently annexed Waukee West properties and will be
purchased at current depreciated values. Council Member Lyon asked about Xenia’s outstanding
debt; Mr. Deets replied that the Two-Mile Agreement was in place prior to Xenia’s financial issues
and subsequent debt restructuring. Results of vote: Ayes: Bergman, Bottenberg, Harrison,

E. Work Session:
1) Waukee Music Festival update – Parks and Recreation Director Jermier briefly reviewed the
status of planning for the Waukee Music Festival.
2) Fireworks use ordinance review – Police Chief Quinn reviewed calls for service related to
fireworks complaints, including comparisons with such calls in other surrounding communities.
Council Member Lyon discussed his observations on the smoke, debris, and noise as a result of
fireworks use, adding that the number of complaints received on the matter lead him to favor
revisions to the ordinance. He added that he also did not want to impose rules that were overly
restrictive. Council Member Harrison echoed Council Member Lyon’s comments, adding his
concerns regarding the direction in which fireworks are launched. He noted some liability
concerns, but expressed his hope that residents would accept responsibility for any damage
caused by their use of fireworks. He voiced support for limiting the number of days and times of
day for fireworks use. Council Member Bottenberg stated that the direction in which fireworks are
launched could be difficult if they are prohibited from being launched from City sidewalks, as some
properties have few flat surfaces. He advocated for use on July 3 and July 4 only, with the
allowance of launching from public sidewalks but not streets. He also noted the amount of debris
remaining following fireworks use. Council Member Harrison added that he saw no need to allow
fireworks use on New Year’s Eve as is currently allowed in the City ordinance. Speaking to the

debris issue, Mayor Peard stated that one cannot control where such debris lands, but that the
ordinance can address allowable dates and times. Council Member Bergman spoke in favor of
modifications to the current ordinance, but speculated that such modifications may not change the
number of service calls to law enforcement. She expressed concern with the nature of the
complaints she received, noting that some were not politely worded. She added that the council
should focus on ways to make fireworks use as safe an activity as possible without imposing too
many regulations, advocating for limiting use to July 3 and July 4. Council Member Hughes
agreed that the current ordinance allowed for too many days of fireworks use, speaking in favor of
2-3 days of use until 10:00 p.m. She did not advocate for the complete repeal of fireworks use, but
voiced her approval for eliminating fireworks use on New Year’s Eve. Mayor Peard agreed with a
reduction in the number of days, adding that there will still be complaints from residents. He noted
that the current ordinance was approved as a pilot program and that the council had learned much
during the 2017 holiday. Council Member Lyon spoke in favor of keeping fireworks use on New
Year’s Eve as a continuation of the pilot program; Mayor Peard agreed. After additional
discussion, Council Member Harrison requested that the council consider two separate actions at
a future meeting: one approving allowed dates and times for fireworks use, and a second to
consider use on New Year’s Eve.
3) Storm warning siren use policy – Fire Chief Robinson reviewed events during a recent storm
when warning sirens failed to activate, citing an equipment failure issue at Westcom. He noted
that failsafe procedures were then implemented and that after he observed that the storm system
had moved to the south, he decided against activating the sirens.
4) Existing tree policy – Development Services Director Deets reviewed the current ordinance
requirements related to existing trees, discussed tree policies in other metro communities, and
recommended certain revisions to the current policy. There was much discussion regarding tree
survey and preservation requirements for the proposed Journey Senior Living project.
