RESOLUTION 17-
A RESOLUTION AUTHORIZING THE DISPOSAL OF REAL ESTATE IN
ACCORDANCE WITH IOWA CODE 364.7(2017)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the City of Waukee owns property legally described as:
THE SOUTHWEST QUARTER (SW1/4) AND THE NORTHWEST QUARTER
OF THE SOUTHEAST QUARTER (NW1/4 SE1/4) OF SECTION 36,
TOWNSHIP 79 NORTH, RANGE 27 WEST OF THE 5TH P.M., DALLAS
COUNTY, IOWA. Subject to any and all easements and restrictions of record.
(the “Property”); AND
WHEREAS, On August 17, 2017 the City received a proposal from Bravo Real Estate, L.L.C to
purchase the Property, and the City Council set forth the proposal by resolution and further set
9:30 a.m. August 24, 2017 as the time and date for public hearing on the proposal, in accordance
with Iowa Code section 364.7 (2017); AND
WHEREAS, the City caused notice of the proposal and public hearing to be published in
accordance with Iowa Code 364.7 (2017), said notice having been published on August 19, 2017
in the Des Moines Register; AND
WHEREAS, on August 24, 2017, the Waukee City Council held a public hearing pursuant to
Iowa Code §364.7 regarding the proposal to sell the Property to Bravo Real Estate, L.L.C; AND
WHEREAS, after the public hearing and due consideration of the proposal concerning the sale
of said Property to Bravo Real Estate, L.L.C., the City Council of the City of Waukee determines
that it is in the best interest of the City to approve the sale of the Property to Bravo Real Estate,
L.L.C. in accordance with the proposal and that said Purchase Agreement should be approved.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
24th day of August, 2017, that, following public hearing as required by Iowa Code 364.7 Code
of Iowa (2017), hereby approves the Purchase Agreement with Bravo Real Estate, L.L.C.
concerning the Property legally described as:
THE SOUTHWEST QUARTER (SW1/4) AND THE NORTHWEST QUARTER
OF THE SOUTHEAST QUARTER (NW1/4 SE1/4) OF SECTION 36,
TOWNSHIP 79 NORTH, RANGE 27 WEST OF THE 5TH P.M., DALLAS
COUNTY, IOWA. Subject to any and all easements and restrictions of record.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the Purchase
Agreement and to execute the deed and other paperwork necessary to effectuate closing on
behalf of the City in accordance with the Purchase Agreement.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 24th day of
August, 2017.
