AGENDA ITEM: Consideration of approval of a resolution approving revised Sanitary Sewer
Easement related to the Northwest Area Trunk Sewer Extension – Phases 2
and 3/Copeland Trunk Sewer – Phase 1 [Phillips-Hamilton, Inc.)

SYNOPSIS INCLUDING PRO & CON: The revised easement is required for the construction of
the gravity sanitary sewer main for the Northwest Area Trunk Sewer
Extension – Phases 2 and 3/Copeland Trunk Sewer – Phase 1. Adjustment to
the easement was necessary to accommodate the revised manhole location the
Spring Crest Plat 2 sanitary sewer main will be connecting to this project’s
sanitary sewer main.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $1.00

RESOLUTION 17-
APPROVING REVISED SANITARY SEWER EASEMENT(S) RELATED TO THE
NORTHWEST AREA TRUNK SEWER EXTENSION PHASES 2 AND 3/COPELAND
TRUNK SEWER PHASE 1 PROJECTS [PHILLIPS HAMILTON, INC.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, it has been determined that a Sanitary Sewer Easement is necessary for the purpose
of construction of the Northwest Area Trunk Sewer Extension Phases 2 and 3/Copeland Trunk
Sewer Phase 1 Projects; AND,
WHEREAS, on April 3, 2017, the Waukee City Council approved a Sanitary Sewer Easement
on a portion of the property owned by Phillips Hamilton, Inc. (Resolution #17-176); AND,
WHEREAS, an adjustment to said easement is necessary to accommodate a revised manhole
location; AND,
WHEREAS, said revised easement shall be located on a portion of the property legally
described as referenced in Exhibit A, Easement Area, of the Sanitary Sewer Easement which is
attached hereto.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
28th day of August, 2017, that it hereby approves the Revised Sanitary Sewer Easement(s)
related to the Northwest Area Trunk Sewer Extension Phases 2 and 3/Copeland Trunk Sewer
Phase 1 Projects [Phillips Hamilton, Inc.] in the amount of $1.00.
