AGENDA ITEM: Consideration of approval of the disposal of real property by sale to
RMCA, LLC pursuant to Iowa Code 364.7 (2017)
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON: The City had previously established the right of way
for the extension of Northview Drive several years ago and prior of the
sale of the ground adjacent to it to RMCA, LLC (Jerry’s Homes) in 2016
for a single family residential development.
As plans have come together for the residential development, Clayton
Estates, it has been determined that the extension of Northview Drive
does not exactly fit within the confines of the Northview Drive Right of
Way as has previously been established.
Staff is recommending consideration of the sale of the existing right of
way for Northview Drive to RMCA, LLC at no cost and in turn, RMCA,
LLC will dedicate back the new right of way for Northview Drive as a
part of the platting process for Clayton Estates Plat 1. The final plat for
Clayton Estates Plat 1 is anticipated to be on the Council agenda for
September 18th.
