HomeMy WebLinkAbout2017-09-05-I03 Sale of Property to RMCA AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: September 5, 2017 AGENDA ITEM: Consideration of approval of a resolution approving the disposal of real property by sale to RMCA, LLC., pursuant to Iowa Code 364.7(2017) FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: RMCA has provided a Plat of Survey for the property to be disposed of (Northview Drive Right of Way). A new right of way for Northview Drive will be dedicated as a part of the final plat for Clayton Estates Plat 1 which is anticipated to be approved on September 18th. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution. WHEREAS, RMCA, LLC., is in the process of developing the adjacent property and has determined that the existing right of way is not consistent with the actual street improvements being constructed and has approached the City and offered to exchange property of the similar size in exchange for the conveyance of the above-described property to RMCA, LLC.; AND WHEREAS, the property RMCA, LLC. proposes to convey to the City is of the similar size and will serve a public purpose for the extension of a public street known as Northview Drive. BE IT THEREFORE RESOLVED by the City Council of the City of Waukee, after a public hearing held on September 5, 2017 to consider the disposal of the property described above in exchange for property owned by RMCA, LLC, hereby approves the disposal of property by conveyance to RMCA, LLC by Quit Claim Deed. The Mayor is authorized to execute any and all documents to effectuate the transaction and convey the property on behalf of the City.
