AGENDA ITEM: Consideration of approval of a resolution approving the disposal of real
property by sale to RMCA, LLC., pursuant to Iowa Code 364.7(2017)
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON:
RMCA has provided a Plat of Survey for the property to be disposed of (Northview Drive Right
of Way). A new right of way for Northview Drive will be dedicated as a part of the final plat for
Clayton Estates Plat 1 which is anticipated to be approved on September 18th.

RESOLUTION 17-
APPROVING A PROPOSAL TO DISPOSE OF THE CITY OF WAUKEE’S INTEREST
IN REAL PROPERTY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City holds property as part of a right of way legally described as:
A PART OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF
SECTION 33, TOWNSHIP 79 NORTH, RANGE 26 WEST OF THE FIFTH PRINCIPAL
MERIDIAN IN THE CITY OF WAUKEE, DALLAS COUNTY, IOWA AND MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF LOT 38, SOUTHVIEW
ESTATES, AN OFFICIAL PLAT; THENCE SOUTH 00°15'51" EAST ALONG
THE EAST LINE OF PARCEL 17-67 AS SHOWN ON THE CORRECTED
PLAT OF SURVEY RECORDED IN BOOK 2016, PAGE 11332, A DISTANCE
OF 97.53 FEET TO THE POINT OF BEGINNING; THENCE SOUTH
00°10'52" EAST, 95.03 FEET TO THE SOUTHERLY LINE OF THE
ACQUISITION PLAT RECORDED IN BOOK 2008 PAGE 14488 AND ALSO
THE NORTH LINE OF PARCEL 17-68 AS SHOWN ON THE CORRECTED
PLAT OF SURVEY RECORDED IN BOOK 2016, PAGE 11332; THENCE
SOUTH 89°48'51" WEST ALONG SAID SOUTHERLY LINE, 698.21 FEET
TO THE SOUTHWEST CORNER OF SAID ACQUISITION PLAT; THENCE

NORTH 44°46'30" EAST, 35.38 FEET TO THE POINT OF BEGINNING AND
CONTAINING 1.12 ACRES (48,987 SQUARE FEET). THE PROPERTY IS
SUBJECT TO ANY AND ALL EASEMENTS OF RECORD.
WHEREAS, RMCA, LLC., is in the process of developing the adjacent property and has
determined that the existing right of way is not consistent with the actual street improvements
being constructed and has approached the City and offered to exchange property of the similar
size in exchange for the conveyance of the above-described property to RMCA, LLC.; AND
WHEREAS, the property RMCA, LLC. proposes to convey to the City is of the similar size and
will serve a public purpose for the extension of a public street known as Northview Drive.
BE IT THEREFORE RESOLVED by the City Council of the City of Waukee, after a public
hearing held on September 5, 2017 to consider the disposal of the property described above in
exchange for property owned by RMCA, LLC, hereby approves the disposal of property by
conveyance to RMCA, LLC by Quit Claim Deed. The Mayor is authorized to execute any and
all documents to effectuate the transaction and convey the property on behalf of the City.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 5th day of
September 2017.
