payment associated with Sanitary Sewer Easement(s) related to the Northwest

SYNOPSIS INCLUDING PRO & CON: V&K calculated the temporary easement compensation
for the Northwest Area Trunk Sewer Extension Phase 4 Project at $6,757.80
when it should have been $13,078.50 resulting in an underpayment of
$6,720.70.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $6,720.70

RESOLUTION 17-
CORRECTING SCRIVENER'S ERROR IN PAYMENT ASSOCIATED WITH
SANITARY SEWER EASEMENT(S) RELATED TO THE NORTHWEST AREA
TRUNK SEWER EXTENSION PHASE 4 PROJECT [PHILLIPS-HAMILTON, INC.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on August 7, 2017, as part of the Consent Agenda, the Waukee City Council
approved Sanitary Sewer Easement(s) related to the Northwest Area Trunk Sewer Extension
Phase 4 Project [Phillips -Hamilton, Inc.] in the amount of $41,100.08 (Resolution #17-367);
AND,
WHEREAS, due to an engineer miscalculation, the payment amount for said easement(s) should
have been $47,820.78;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
11"' day of September, 2017, hereby approves correcting a scrivener's error in payment
associated with Sanitary Sewer Easement(s) related to the Northwest Area Trunk Sewer
Extension Phase 4 Project [Phillips -Hamilton, Inc.], so that the total easement payment amount is
corrected to $47,820.78; AND,
BE IT FURTHER RESOLVED, as payment in the amount of $41,100.08 has already been
made to and received by Phillips -Hamilton, Inc., the City of Waukee Finance Department is
hereby directed to issue payment to Phillips -Hamilton, Inc., for the difference of $6,720.70;
AND,
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to record an amendment
to the Sanitary Sewer Easement(s) approved on August 7, 2017, and recorded with the Dallas
County Recorder under Book 2017 Page 15781.
