WAUKEE CITY COUNCIL MINUTES
September 5, 2017
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Pro
Tem Bergman at 5:37 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Council Members Anna Bergman, Brian Harrison
(via telephone), Shelly Hughes, Larry R. Lyon. Absent: Mayor William F. Peard, Council Member R.
Charles Bottenberg. (Council Member Harrison ended participation at 5:51 p.m.)
Also present: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public Works
Director John Gibson, Development Services Director Brad Deets, Community and Economic
Development Director Dan Dutcher, Parks and Recreation Director Matt Jermier, Police Chief John
Quinn, City Clerk Rebecca D. Schuett, City Attorney Steve Brick.

(E) Agenda Approval – Council Member Hughes moved to approve the agenda, tabling item J2;
seconded by Council Member Lyon. Results of vote: Ayes: Bergman, Harrison, Hughes, Lyon.
Nays: None. Absent: Bottenberg. Motion carried 4 – 0 – 1.

(H) Public Hearings:
1) On an ordinance to amend Chapter 301, Zoning Ordinance, City of Waukee, Iowa, by
rezoning and changing certain property therein from A-1 to M-1 and PD-1, a property
known as Bravo Real Estate, LLC – Mayor Pro Tem Bergman opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets briefly reviewed the rezoning request for
approximately 2,100 acres related to the Apple Data Center project. The PD-1 overlay includes
modifications to overall bulk regulations, parking, landscaping and buffering. Mr. Deets reviewed
a concept plan for two initial data center buildings, including exterior elevations. The remaining
acres are planned for future development. All property owners within the subject area have
signed consent forms related to the proposed rezoning; rezoning is contingent upon the sale of
those properties to Apple. No comments were made by the public present.
2) On the disposal of real property by sale to RMCA, LLC., pursuant to Iowa Code 364.7
(2017) – Mayor Pro Tem Bergman opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets briefly reviewed the property sale, which corrects the right-of-way along
a portion of Northview Dr. due to an alignment modification for that street segment. No
comments were made by the public present.
3) On the vacation of a public water main easement [Waukee Vista Commercial Park, Lots 1-
5] – Mayor Pro Tem Bergman opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets briefly reviewed the easement vacation, which is necessary due to
building location on the subject lots. No comments were made by the public present.
4) On plans, specifications, form of contract and estimate of cost [Windfield/High School
Trail Phase 1 Project] – Mayor Pro Tem Bergman opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative. Public
Works Director Gibson briefly reviewed the project, noting that easements are still needed for the
project. The Waukee Community School District will reimburse the City for a portion of trail. No
comments were made by the public present.
(I) Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution approving City of Waukee
Comprehensive Plan 2008 amendment – Council Member Lyon moved to approve the
resolution; seconded by Council Member Hughes. Development Services Director Deets noted
that the amendment was related to both the Bravo Real Estate rezoning and the future Waukee

West Urban Renewal Area. The Apple site would be designated as an “Employment Land Use”
within the Comprehensive Plan amendment. Council Member Bergman stated that she would
abstain from the vote, as she has family currently in property sale negotiations with Apple.
Results of vote: Ayes: Harrison, Hughes, Lyon. Nays: None. Abstention: Bergman. Absent:
Bottenberg. Motion carried 3 – 0 – 1 – 1. (Resolution #17-418)
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 301, Zoning

None. Abstention: Bergman. Absent: Bottenberg. Motion carried 3 – 0 – 1 – 1. (Council

3) Resolution: Consideration of approval of a resolution approving the disposal of real
property by sale to RMCA, LLC., pursuant to Iowa Code 364.7 – Council Member Hughes
moved to approve the resolution; seconded by Council Member Lyon. Results of vote: Ayes:
Bergman, Hughes, Lyon. Nays: None. Absent: Harrison, Bottenberg. Motion carried 3 – 0 – 2.

4) Resolution: Consideration of approval of a resolution approving the vacation of a public

moved to approve the resolution; seconded by Council Member Lyon. Results of vote: Ayes:

5) Windfield/High School Trail Phase 1 Project
A. Resolution: Consideration of approval of a resolution approving plans and
specifications, form of contract and estimate of cost – Council Member Lyon moved to
approve the resolution; seconded by Council Member Hughes. Results of vote: Ayes:
Bergman, Hughes, Lyon. Nays: None. Absent: Harrison, Bottenberg. Motion carried 3 – 0 –
2. (Resolution #17-421)
B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Hughes moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director Gibson briefly reviewed the bid tabulation and project schedule,
making recommendation for award to Concrete Professionals of Altoona, IA. Council
Member Lyon asked if the City had prior experience with the vendor; Mr. Gibson replied in
the negative, but noted that other cities recommended their work. Council Member Hughes
amended the motion to approve the resolution, awarding contract to Concrete Professionals
of Altoona, IA, in the amount of $142,405.20; Council Member Lyon amended the second.
Results of vote: Ayes: Bergman, Hughes, Lyon. Nays: None. Absent: Harrison, Bottenberg.
Motion carried 3 – 0 – 2. (Resolution #17-422)

502.10(S), Parking Regulations – Centennial Park [introduction, first reading] – Council
Member Hughes introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Lyon. Parks and Recreation Director Jermier cited complaints
regarding student vehicles in Centennial Park, leaving no parking available for park users. The
proposed ordinance limits parking to a two-hour maximum on weekdays during the school year
for those parking areas in Centennial Park other than along Park Rd. Council Member Lyon

asked if there was any comment from the Waukee Community School District on the proposed
parking restrictions; Mr. Jermier stated that Superintendent Cindi McDonald supports the
restrictions. Results of vote: Ayes: Bergman, Hughes, Lyon. Nays: None. Absent: Harrison,

4) Resolution: Consideration of approval of a resolution awarding contract [I-80 West
Industrial Park Lift Station and Water Main Extension Project] – Council Member Lyon
moved to approve the resolution; seconded by Council Member Hughes. Public Works Director
Gibson stated that City staff continues to work with the property owner on a development
agreement and requested that the contract award be deferred to the 09/18 council meeting.
Council Member Lyon amended the motion, deferring award of contract until the 09/18 regular
council meeting; Council Member Hughes amended the second. Results of vote: Ayes:

aware of future development plans for that property; Mr. Deets replied in the negative. Results

A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Pro Tem
Bergman at 5:36 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Council Members Anna Bergman (via telephone), R.
Charles Bottenberg, Brian Harrison, Shelly Hughes, Larry R. Lyon. Absent: Mayor William F. Peard.
(Mayor Peard arrived at 5:45 p.m.)

D. Work Session:
1) Meaningful Leader training – Human Resource Director Holden briefly reviewed the initiative,
which will foster a culture of employee engagement. (Mayor Peard arrived at 5:45 p.m.)
At this time, Robert Greenway of De Soto asked to address the council, updating them on county-
wide efforts to promote the upcoming local option sales and service tax vote.
2) IT projects update – IT Director Le presented on back-up server and software, Unified Threat
Management, and core switch replacement projects.
3) Original Waukee Storm Sewer Study – Public Works Director Gibson reviewed certain public
improvement projects undertaken to remedy sewer issues, including sanitary sewer lining, storm
sewer televising, and storm sewer cleaning.
4) Urban Renewal Plan update review – Development Services Director Deets discussed proposed
new and amended urban renewal plans and TIF ordinances.
5) Comprehensive Plan update – Development Services Director Deets reviewed citizen survey
results.
6) Waukee Sesquicentennial scheduling – City Administrator Moerman noted that the 1869 date
used in prior years to mark Waukee’s establishment is the year the first railbed was installed; the
city was incorporated in 1878. The council agreed to use the more-accurate 1878 incorporation
date moving forward, placing Waukee’s Sesquicentennial in 2028.

7) Policy regarding contributions to non-profit entities – City Administrator Moerman asked for
council direction regarding which non-profit groups to invite to submit funding requests, presenting
a list of potential entities to consider. The council agreed to invite all those entities noted by Mr.
Moerman to submit funding requests. City staff will draft criteria for non-profit entities to be
considered for funding and report to the council at the next work session meeting.
8) Board and commission code of conduct – City Administrator Moerman and City Clerk Schuett
reviewed a proposed code of conduct. The council agreed to consider the proposal and discuss
the matter at the next work session meeting.
