AGENDA ITEM: Consideration of approval of an ordinance to repeal Chapter 106, Places for
Public Posting of Agendas or Other Public Notices, and replacing it in its
entirety [introduction; first reading]

SYNOPSIS INCLUDING PRO & CON: In order to streamline the agenda posting
process, City staff recommends that Chapter 106 be revised so that
agendas and notices are posted at Waukee City Hall. The current
ordinance designates Waukee City Hall, the Waukee Post Office, and the
American Legion/VFW Hall as official posting locations.

STAFF REVIEW AND COMMENT: Agendas are also made available to the public via the
City website and social media links.
RECOMMENDATION: Introduce the ordinance and approve the first reading in title only.

AN ORDINANCE TO REPEAL CHAPTER 106, PLACES FOR PUBLIC POSTING OF
AGENDAS OR OTHER PUBLIC NOTICES, AND REPLACING IT IN ITS ENTIRETY
[INTRODUCTION; FIRST READING]
WHEREAS, the City of Waukee has determined a need to amend the locations for public
posting of agendas and other public notices.
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1: Chapter 106, Waukee Municipal Code, Places for Public Posting of Agendas
or Other Public Notices, should be and the same is hereby repealed and enacted in lieu thereof is
as follows:
§106.1 Purpose. All meetings of the Council, and any board or commission formally
created by the Council, shall post reasonable notice of meetings as defined by State law of the time,
date, and place of each meeting and its tentative agenda shall be given. All meetings shall be held
in open session unless closed sessions are held as expressly permitted by State law.
§106.2 Listing of Places of Posting and Length of Notice. Public notice of agendas
and other matters permitted to be posted shall be displayed at Waukee City Hall in a prominent
location easily accessible to the public.
Agendas are to be posted at least twenty-four (24) hours prior to the meeting and may be removed
after the meeting for which the agenda is posted. Other notices must remain posted for the length
of time required by the notice or by State law.
§106.3 Unlawful Removal of Notice. Removal of a public notice by persons other
than the City Clerk or his/her designee prior to the end of the meeting which is being noticed, or for
other notices before the date required by State law, shall be a misdemeanor.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect from and after its final
passage, approval and publication as provided by law. The increases shall not take effect until
January 1, 2018 for council members and January 1, 2020 for mayor.
