AGENDA ITEM: On an ordinance to amend Chapter 301, Zoning Ordinance, City of
Waukee, Iowa by rezoning and changing certain property therein from
A-1 (Agricultural District) to M-1 (Light Industrial District), a parcel to
be known as I-80 West Industrial Park Plat 2.
FORMAT: Public Hearing
SYNOPSIS INCLUDING PRO & CON: The applicant, 117 Land Company, LLC, requests
approval of a rezoning of approximately 67.66 acres of property located
south of Interstate 80 and west of Ute Avenue/R-22. The specific
request is to rezone the property from A-1, Agricultural District to M-1,
Light Industrial District in order to develop a light industrial/business
park.
The subject property was recently annexed into the City of Waukee and
would become the second phase of the I-80 West Industrial Park for
which construction began in summer 2017.
The concept plan submitted with the application indicates a total of 9 lots
for light industrial development. One outlot on the west side of the
property is also indicated. Interstate Parkway is indicated as continuing
further to the west.
The rezoning is consistent with the Comprehensive Plan which identifies
the property as an area for development of light industrial/business parks.
The property is also consistent with the adjacent land uses to the east.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their November 14, 2017,
meeting and recommended approval.
Approval of a Rezoning related to a Change from A-1 (Agricultural District) to M-1 (Light
Industrial District) [I-80 West Industrial Park]
City Planner, Melissa DeBoer, introduced the request for rezoning made by the applicant 117
Land Company, LLC. The subject property is generally located south of Interstate 80 and west of
R-22 containing approximately 67.66 acres. The proposed rezoning would convert the entire
subject property to M-1, light industrial district as identified in the City’s 2008 Comprehensive
Plan for the location of a future business park. The applicant has submitted the necessary petition
and consent to the rezoning and to date, staff has not received any correspondence for or against

the proposal. The applicant has submitted a concept plan identifying the anticipated layout of the
development with 9 lots and one out lot. The street from plat 1 will continue west into plat 2, and
utilities will be extended to the property as plat improvements. At this time Staff recommends
approval of the proposed rezoning request.
• Commissioner Stonebrook questioned where the road would end. Senior Planner Andy
Kass advised that the submittal is just a concept plan, but the applicant has states some
grading issues in extending the road straight to the west.
• Commissioner Hoifeldt asked what would be done with the Creek in lot 2. Mr. Kass
advised that, due to entities like the DNR, the creek would need to be maintained in its
current state and not altered for development.
• Commissioner Stonebrook asked for clarification on the utilities being extended. Mr.
Kass advised that the City is constructing a lift station to east of this development, the
area shown, plats 1 and 2, can all be serviced by the extended utilities.
Commissioner Tietz moved to approve a rezoning related to a change from A-1 (agricultural
district) to M-1 (light industrial district. the motion was seconded by Commissioner Hoifeldt.
Ayes: Stonebrook, Fontenot, Streit, Hoifeldt, and Tietz. Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: The proposed rezoning request is consistent with the
Comprehensive Plan and surrounding land uses.
RECOMMENDATION: Introduce the Ordinance and approve the first consideration.

BACKGROUND:
The applicant, 117 Land Company, LLC, is requesting approval of a rezoning of approximately 67.66 acres of
property located west of R-22 and south of Interstate 80. The proposed rezoning includes rezoning all of the
67.66 acres to M-1, Light Industrial District. The subject property was identified in the City’s 2008
Comprehensive Plan as the location for a future business park.
The Waukee City Council has previously identified as a priority the development of light industrial property
and has targeted the I-80/R-22 area for this type of development. The City has previously worked with the
property owner north of I-80 and west of R-22 on a light industrial business park, however, nothing has
transpired to date.

This property has recently been annexed into the City of Waukee and is the second phase of rezoning for the
I-80 West Industrial Park. Plat 1, located immediately to the east was recently rezoned from A-1, Agricultural
District to M-1, Light Industrial District and C-1, Community and Highway Service Commercial District in May
2017.
PROJECT DESCRIPTION:
The applicant has submitted the necessary petition and consent to the rezoning. Notification of the rezoning
request to the proposed property was sent on November 6, 2017. To date, staff has not received any
correspondence for or against the proposal. Notification signs of the proposed Planning and Zoning Date and
City Council Public Hearing Date have been placed on the property.

As a part of the proposed rezoning request, the applicant has submitted a concept plan identifying the
anticipated layout of the development. The concept plan identifies a total of 9 light industrial lots and one
outlot on the west boundary. The street from Plat 1 will continue west into Plat 2 and then curve to the
south.
The City is currently working with the applicant on the extension of utilities to service the project. The City’s
consulting engineer has begun preliminary design of the extension of a 12” water main to extend under
Interstate 80 to service the property. A lift station is also being designed that would be located in the

southwestern portion of the subject property which would include a force main back to the north and into
the existing sanitary sewer system located north of Interstate 80.
STAFF RECOMMENDATION
The proposed rezoning is consistent with the comprehensive plan previously developed for this area and is
also consistent with the City Council’s priority to work with property owners in the development of light
industrial/business parks. Staff would recommend approval of the proposed rezoning request.
