AGENDA ITEM: On an ordinance to amend Chapter 301, Zoning Ordinance, City of
Waukee, Iowa by rezoning and changing certain property therein from
A-1 (Agricultural District) to M-1 (Light Industrial District), a parcel to
be known as I-80 West Industrial Park Plat 2 [introduction; first reading]

COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff would recommend approval of the first
consideration to rezone the property.
RECOMMENDATION: Introduce the Ordinance and approve the first reading of the ordinance
in title only.

AN ORDINANCE TO AMEND CHAPTER 300, ZONING ORDINANCE, CITY OF WAUKEE,
IOWA BY AMENDING CERTAIN PROPERTY FROM A-1 TO M-1 [I-80 WEST
INDUSTRIAL PARK PLAT 2]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 301.4 of Chapter 301, Waukee Municipal Code, Zoning Ordinance of
the City, adopting the Official Zoning Map, is hereby amended by changing the following real estate
from A-1 (Agricultural District) to M-1 (Light Industrial District), legally described as follows:
THE PART OF THE NORTH FRACTIONAL ONE-HALF (N 1/2) OF THE NORTHEAST
QUARTER (NE 1/4) OF SECTION EIGHTEEN (18), TOWNSHIP SEVENTY-EIGHT (78) NORTH,
RANGE TWENTY-SIX (26) WEST OF THE 5TH P.M., DALLAS COUNTY, IOWA, LYING
SOUTH OF INTERSTATE ROUTE NO. 80, EXCEPT PARCEL “A” OF THE SURVEY OF THE
FRACTIONAL NW 1/4 NE 1/4, SECTION 18-78-26, AS SHOWN IN BOOK 748, PAGE 599, IN
THE OFFICE OF THE RECORDER OF DALLAS COUNTY, IOWA.
SAID PARCEL TO BE REFERRED TO AS I-80 WEST INDUSTRIAL PARK PLAT 2.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as
a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.
