The November 2nd, 2017 Board of Adjustment meeting was called to order at 5:30P.M by Chairman Doug Drees. Roll Call. The Chair asked for a roll call and the following Board Members were present: Breckenridge, Irvin, Drees, and Myers. Absent: Board Member Garcia. City Staff in attendance: Melissa DeBoer, Andy Kass, and Kathryn Purvis. Applicants in attendance: Scott Anderson, a representative of the Applicant. Approve the November 2nd, 2017 Agenda. Board Member Brekenridge made a motion, seconded by Board Member Irvin, to approve the agenda for November 2nd, 2017. Ayes: Breckenridge, Irvin, Drees, and Myers. Nays: None. Motion carried. Approve the June 8th, 2017 Board of Adjustment Minutes. Board Member Myers made a motion, seconded by Board Member Brekenridge, to approve the Board of Adjustment meeting minutes for June 8th, 2017 as written. Ayes: Breckenridge, Irvin, Drees, and Myers. Nays: None. Motion carried. Application for 125 SE Laurel Street (Lots 7,8, and 9 in Windfield Commercial plat 1)- Variance from 305.6.F.I.iii. of the Waukee Municipal Code to allow ground directional signage to display to allow more than two wall signs. Senior Planner, Andy Kass, introduced the request made by the Applicant, Mc Donald’s Real Estate Company. Mr. Kass advised that the request would allow for a variance of the Waukee Municipal Code to allow ground directional signage to display logos or commercial messages and a variance to allow more than two wall signs. At this time there has been no written correspondence against the requested variance. Mr. Kass explained that the applicant has noted that the lot is large and surrounded by three public streets, and allowing branding will help customers navigate the location. The applicant has also noted that another building in a similar situation has branding on an ATM machine which has three wall signs. The applicant has noted that directional signage helps with traffic flow and they believe it is in the public interest to help prevent undue injury or endangerment. Staff will not make a recommendation on the requested variance and will leave the decision to the Board of Adjustments based upon the merits and criteria of the requested variances. Staff does have a few points for the Board to keep in mind: The applicant could install directional signage without logos that would still direct customers to the desired locations. The sign ordinance allows for wall signage along two street frontages which the existing facility already has. This is not a new location for the applicant. The property has three street frontages, which is not common.  Member Irvin questioned if the Wells Fargo next to the applicant was granted a variance. Mr. Kass advised that the signage was approved prior to the adoption of the current Ordinance. Other locations that face similar issues as the applicant have worked with staff to provide signage that fits within the Ordinance.  Member Breckinridge advised that he had been to some of the other businesses, and that the updated directional signs did make navigation easier. Member Drees added that the Logo addition is more of a commercial interest over a public interest, and the Board would need to be sure they were not setting a bad precedent by allowing it.  Member Myers questioned how the loss of the logo would affect the signage and what limitations there were on what could be installed as directional signs. Mr. Kass advised that there is a limit on size and what could be used, something like a digital sign would not be approved as they are allowed in a monument sign. There is enough limitations that the board would be able to review future similar requests and approve or deny on an individual basis.  Member Drees questioned what the hardship was for directional signs. Scott Anderson, a representative for the applicant, advised that the signs without the logo would be one foot thinner. He also advised that the logo clearly identifies the location and available entries.  Member Myers advised that he did not find an issue with the third wall sign as there used to be a sign when the gas station was a part of the building.  Member Breckenridge moved to approve the variance from 305.6.F.I.iii of the Waukee Municipal code to allow ground directional signage to display logos or commercial messages and a variance from 305.8.A.2. if the Waukee Municipal Code to allow more than two wall signs. The Motion was seconded my Member Myers. Ayes: Breckenridge, Irvin, Drees, and Myers. Nays: None. Motion carried. Old Business There is no old business New Business Senior Planner Andy Kass advised that there may be a few future variances for signage in the near future. Mr. Kass also advised that the Planning and Zoning Commission is going to have a few open seats at the beginning of the year if anyone is interested in applying. Adjournment Member Irvin moved to adjourn the meeting. The motion was seconded by member Breckenridge. Ayes: Breckenridge, Irvin, Drees, and Myers. Nays: None. Motion carried. The November 2nd, Board of Adjustment Meeting was adjourned at 6 PM.
