release request

SYNOPSIS INCLUDING PRO & CON: Painted Woods Farms, an entity of Kum & Go, was
recently made aware of a scenic easement that encumbers a piece of property
that they own located at the northeast corner of Interstate 80 and R-22/Ute
Avenue. The easement restricts the ability to further develop the property
beyond its current use for agricultural purposes today.
Kum & Go has requested the City provide a letter for purposes of submitting
it to the Department of Transportation in support of releasing the easement on
the property.
The City has previously extended utilities within the area to serve the subject
property and development of the property will also provide a secondary access
to the Painted Woods subdivision.

STAFF REVIEW AND COMMENT: Staff would recommend approval of the Mayor signing the
requested letter.
RECOMMENDATION: Approve the signing of the letter

RE: Painted Woods Farms, LLC – Scenic Easement
Dear Ms. DePhillips:
The City of Waukee has recently been made aware of the existence of a Scenic Easement on property owned
by Painted Woods Farms LLC and generally located at the northeast corner of the intersection of Interstate 80
and R-22/Ute Avenue (Mile Marker 117). The City understands that the easement was granted in 1967 and
restricts and limits further development of the property beyond its current use today for agricultural
purposes.
The City of Waukee has seen significant and planned growth over the last decade including a natural
outgrowth of development south towards Interstate 80. In anticipation of this growth, the City has made
significant investment in utilities and other infrastructure to support both residential and commercial
development.
Although the City appreciates the intent and purpose of the scenic easement, we believe that with the
development that has occurred within the surrounding area that there is a higher and better use for this
property.
The City of Waukee supports your efforts in working with the Iowa Department of Transportation in the
release of the existing Scenic Easement.
