HomeMy WebLinkAbout2017-11-20-J04 Bel-Aire Parking Ordinance_2ND-3RD READ AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: November 20, 2017 AGENDA ITEM: Consideration of approval of an ordinance to amend Chapter 502, Waukee Municipal Code, Traffic Regulations of the City of Waukee, Iowa, by adding to Section 502, Parking Regulations, certain public streets as specified (Bel-Aire Drive) [second, third (final) readings] FORMAT: Ordinance SYNOPSIS INCLUDING PRO & CON: FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: City staff recommends that the third reading of the ordinance waived so that the proposed parking regulations go into effect as soon as possible. The Code of Iowa requires a vote of not less than three-fourths of all the members of the council (or 4 out of 5 for Waukee) in order to waive readings of an ordinance. RECOMMENDATION: Approve the second reading of the ordinance in title only, waive the third reading, and place to ordinance on final passage. ATTACHMENTS: I. Proposed Ordinance PREPARED BY: Becky Schuett REVIEWED BY: ORDINANCE NO. 17-_________ AN ORDINANCE TO AMEND CHAPTER 502, WAUKEE MUNICIPAL CODE, TRAFFIC REGULATIONS OF THE CITY OF WAUKEE, IOWA, BY REMOVING FROM SECTION 502 “PARKING REGULATIONS,” A CERTAIN PUBLIC STREET AS SPECIFIED BELOW WHEREAS, the City of Waukee has determined that a certain public street should be added to the no parking ordinances. BE IT ORDAINED by the Council of the City of Waukee: Section 1. Chapter 502, Waukee Municipal Code, Traffic Regulations, Section 502.8, is hereby amended by repealing and enacting in lieu thereof the following subsection I: §502.8 Other parking prohibitions on east-west streets: I. No parking on either side of Bel-Aire Drive from its intersection with Warrior Lane to a point 195 feet to the west. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
