HomeMy WebLinkAbout2017-11-20-J13 Daybreak Plat 2_Final Plat AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: November 20, 2017 AGENDA ITEM: Consideration of approval of a resolution approving a final plat for Daybreak Plat 2 FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: Daybreak Waukee, LLC, request approval of a final plat for 20.23 acres of property located north of Ashworth Road and west of R- 22/Ute Avenue. The final plat includes a total of 41 lots for single family residential development. The applicant has extended utilities throughout the development and constructed an extension of Daybreak Drive and three new streets: Crescent Ridge Drive, Scenic View Drive, and Sunflower Drive. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed this request on September 26, 2017, and recommended approval subject to remaining staff comments. Approval of a Final Plat for Daybreak Plat 2 City Planner, Melissa DeBoer, introduced the request for approval of a final plat made by the applicant Daybreak Waukee, LLC. The subject property is located west of Ute Avenue and north of Ashworth Road, containing a little over 20 acres. The property is zoned R-1, Single Family Residential. The plat contains a total of 41 single family residential lots. The lots range in size from about 10,000 square feet to about 49,000 square feet. There are three out lots located at the north end of the plat. These out lots were created in order to clean up the proposed residential lot boundaries. All out lots will be owned and maintained by a Homeowner’s Association. All lots will be served with public utilities. Five foot sidewalks will be constructed on both sides of the streets with individual lot development. Storm water detention is being provided with the detention basin that is being constructed north of Ashworth Road, within the parkland. Parkland dedication has been satisfied for both Daybreak Plat 2 and 3. Staff is recommending approval of the final plat for Daybreak Plat 2 subject to any remaining staff comments and review of the legal documents by the City Attorney. Commissioner Streit questioned if the “finger” area in the northwest corner of the plat had been designated as an out lot. Mrs. DeBoer advised that was correct, and that it would be maintained by the Homeowner’s Association. Commissioner Streit questioned how the Association would gain access. J13 Jake Becker, a representative of the applicant, advised that there is no direct access, it would be addressed with the homeowner of the lot for the care. Senior Planner Andy Kass advised that in cases such as this, there was verbiage added to the Covenants of the development outlining the care and maintenance of an area that was inaccessible. Commissioner Hoifeldt questioned if the triangular piece off of Sunflower Drive would have the same issue as it appeared to not have access. Mr. Becker advised that it would be cared for, and that if the lot north of the subject property was developed by the applicant, it would be integrated into a lot. Commissioner Stonebrook questioned how the dedication of parkland worked as the dedication required for the subject property would not be available until the third phase. Mr. Kass advised that it wasn’t uncommon to have something like this happen when dealing with larger parcels dedicated to parkland. Mr. Kass also noted that the parkland had been measured to add some additional space as a dry bottom detention pond was proposed in the area for storm water management, staff and the applicant created an agreement to allow the pond as long as the land equal to what was used in the area, was supplied in another location. Commissioner Stonebrook questioned what the temporary plan for storm water detention would be until the completion of phase 3. Mr. Kass advised that the applicant proposed grading to create a swale to guide the drainage to the designated temporary location. Commissioner Streit moved to approve the Final Plat for Daybreak Plat 2 with the addition of verbiage related to the care and maintenance of the inaccessible out lots to be placed in the covenant documents and subject to staff comments and review of the legal documents by the City Attorney. Commissioner Hoifeldt seconded the motion. Ayes: Stonebrook, Streit, Hoifeldt, and Tietz. Nays: None. Motion Carries. STAFF REVIEW AND COMMENT: All staff comments have been addressed. The developer, Daybreak Waukee, LLC, requests approval of a final plat for a 41 lot single-family residential subdivision. The lots are a minimum of 10,000 square feet in size. All of the lots are indicated as having the required 30 foot front yard setback. The outlots are located at the north boundary of the plat. These outlots were created in order to clean up the residential lot boundaries. Outlot X is located just north of Lot 25 and is 34,986 square feet; Outlot Y is north of Lot 14 and is 2,504 square feet; and Outlot Z is north of Lot 13 and is 4,332 square feet. All outlots will be owned and maintained by the Home Owner’s Association. Streets: Daybreak Drive will continue west from Daybreak Plat 1. Scenic View Dr, Sunflower Dr, and Crescent Ridge Dr are the north/south streets that are also included within this plat. Five foot sidewalks will be constructed on both sides of the streets throughout the plat as part of individual lot development. Easements: Several easements are proposed within the plat based upon the location of proposed utilities. DAYBREAK PLAT 2 DAYBREAK PLAT 3 September 21, 2017 3 of 3 Utilities: All lots will be served with public utility services. A majority of storm water from this plat will be routed to the proposed detention basin within the parkland, located just north of Ashworth Road, dedicated within Daybreak Plat 3, which will be the next phase of platting. Parkland Dedication As part of the development of this plat the applicant is required to dedicate parkland, for which the amount required in this case is 1.57 acres. The applicant has provided 2.68 acres of parkland just north of Ashworth Road. Parkland dedication has been satisfied for both Daybreak Plat 2 and 3. STAFF RECOMMENDATION At this time staff feels comfortable with the proposal and would recommend approval of the Final Plat for Daybreak Plat 2 subject to remaining staff comments and review of the legal documents by the City Attorney.
