AGENDA ITEM: Consideration of approval of a resolution approving a final plat for Deery
Brothers Waukee Development
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: Deery, Deery, & Deery, LLC, request approval of a final
plat for 24.85 acres of property located south of Hickman Road and west of
10th Street. The final plat includes a total of one lot and one outlot. Lot 1 is
9.05 acres in area and is proposed to be utilized for the construction of a
Deery Brothers car dealership. Outlot X is 14.36 acres in area and will be
developed for future commercial/retail uses.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission
reviewed this request on November 14, 2017, and recommended approval subject to remaining
staff comments.
Approval of a Final Plat for Deery Brothers Waukee Development
Commissioner Streit recuses his vote for this subject due to a conflict of interests.
Senior Planner, Andy Kass, introduced the request for a Commercial/retail development final plat
made by the applicant Deery, Deery, and Deery, LLC and the Rose Companies. The subject property
is generally located south of Hickman Road and west of 10th street containing approximately 21.80
acres. The Final Plat indicates two lots; lot 1 and out lot X, for commercial development. As part of
site improvements for this plat, 10th street will be extended from Hickman Road to the south plat
boundary, Future development of the property will require construction of Maple Street and 11th street.
A ten foot wide trail along the west side of 10th Street will also be constructed during site
improvements. All Public Utilities will serve the location.
• Commissioner Hoifeldt questioned what the intent for 10th Street was long term. Mr. Kass
advised that the applicants plan to complete grading and utility work over the winter and pave
in the spring.
• Commissioner Tietz questioned if the applicant was only responsible for paving half of 10th
Street. Mr. Kass advised that was correct. The City does not require a developer to construct
the west two lanes as traffic demands the City will complete the east two lanes.
• Commissioner Stonebrook questioned if the street marking on the provided document
indicated 2 or 4 lanes. Mr. Kass advised that it only indicated the left 2 lanes, but also shows
the current street alignment for reference.
• Commissioner Tietz clarified that 10th Street would not be a boulevard to Hickman. Mr. Kass
advised that was correct.

• Commissioner Stonebrook clarified that the angle of the proposed street was to make a
connection to the intersection. Mr. Kass advised that was correct.
• Commissioner Streit questioned what the future of Ashworth Drive is. Mr. Kass advised that it
would remain as it is for the time being, but that in the future it would be closed off due to
proximity to the intersection.
• Commissioner Tietz questioned what the timeline to build would be. Mr. Kass advised the
applicant would more than likely seek to start construction in the spring.
Commissioner Hoifeldt moved to approve a Final Plat for Deery Brothers Waukee development. The
motion was seconded by Commissioner Stonebrook. Ayes: Stonebrook, Fontenot, Hoifeldt, and Tietz.
Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: All comments have been addressed. Staff recommends
approval.
RECOMMENDATION: Approve the resolution.

APPROVING THE FINAL PLAT FOR DEERY BROTHERS WAUKEE
DEVELOPMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Deery, Deery, & Deery, LLC, has requested final approval of Deery Brothers
Waukee Development (the “Plat”); AND
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of
the Plat on November 14, 2017, subject to remaining staff comments and review of the legal
documents; AND,
WHEREAS, the Final Plat for Deery Brothers Waukee Development and the documents relating
thereto will comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal
Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa
on this 18th day of December, 2017, that the Final Plat for Deery Brothers Waukee Development
be and the same is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
easements and documents to be filed with the Plat:
1. Warranty Deed;
2. Storm Water Management Facility Maintenance Covenant & Permanent
Easement Agreement;
3. Public Storm Sewer & Public Sanitary Sewer Easement;
4. Landscape Buffer Easement; and
5. Private Ingress/Egress Easement

BACKGROUND:
The subject property is located south of Hickman Road and west of 10th Street and is approximately 21.80
acres in area. The property was annexed and rezoned in 2016. The applicant requests approval of a final plat in
order to plat one lot and one outlot for commercial/retail development.

Project Description:
Lots:
The final plat includes 2 lots for commercial development. Lot 1 is 9.05 acres in area and Outlot X is 12.75
acres in area. Outlot X is for future development. All proposed lots are in conformance with C-1 zoning
district requirements.
Streets & Sidewalks:
As part of the improvements for this plat 10th Street will be extended from Hickman Road to the south plat
boundary. 10th Street will eventually be a 4 lane boulevard, but at this time the applicant will only be
responsible for constructing the west 26 feet of the street. Future improvements will be made as traffic counts
warrant improvements. Future development of the property will require construction of Maple Street and 11th
Street.
A ten foot wide trail along the west side of 10th Street will be constructed as part of the development of the
car dealership.
Easements:
Several easements are proposed within the plat based upon the location of proposed utilities and construction
areas.

A 30 foot landscape buffer easement will be required along the south and east plat boundary to provide
screening from the adjacent and future residential development.
Utilities:
Water main will be extended to Lot 1 and a 12-inch water main will be extended along 10th Street and
Hickman Road. An 8-inch sanitary sewer will be brought up to the property from the south. Storm water
detention for the plat will be provided for in a pond on the southwest side of Outlot X.
STAFF RECOMMENDATION
At this time Staff feels comfortable with the proposal and would recommend approval of the Final Plat for
Deery Brothers Waukee Development subject to remaining staff comments.
