AGENDA ITEM: Consideration of approval of a resolution approving farm lease
(amended) with Josh Weems
FORMAT: Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The farm lease is between Josh Weems and the City
for the remaining Clayton farm tillable acres. There is currently an
approved lease for the land; however with the school building their
transportation facility on a portion of the leased area thus reducing it,
Steve Brick asked that the lease be amended with the revised & reduced
tillable acres. The original lease was set up on 50 acres removing 21
acres from production for the Waukee Schools Transportation Facility
giving a credit for $2725.00 leaving 29 left. The new lease is $200 an
acre X 29 acres left is $5,800.00 crediting the $2,725.00 leaving
$3,075.00.

RESOLUTION 16-
APPROVING A FARM LEASE (AMENDED) WITH JOSH WEEMS
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized
Municipal Organization; AND,
WHEREAS, the City acquired property for future municipal purposes; AND,
WHEREAS, the property was formerly terraced farm ground and has, since its acquisition,
been partially developed in different areas to be occupied by the new Waukee Public Works
Facility, and a facility for the Waukee Community School District; AND,
WHEREAS, portions of the property remain undeveloped, and are not intended to be
developed during the upcoming growing season; AND,
WHEREAS, on May 6, 2013, the Waukee City Council approved a three-year lease with
Josh Weems to plant the undeveloped parcels tillable ground with an alfalfa cover crop
(Resolution #13-115); AND,
WHEREAS, the City of Waukee has recently sold a portion of the subject property to the
Waukee Community School District, requiring an amendment to the Farm Lease to properly
describe the portion of the property that continues to be under City of Waukee ownership.
NOW THEREFORE BE IT RESOLVED by the Waukee City Council that the amended
lease attached hereto as Exhibit A should be and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute the same on behalf
of the City.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 18th day of
January, 2016.
