HomeMy WebLinkAbout2016-01-18-J07 WCSD Fueling Facility 28E Agreement AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: January 18, 2016 AGENDA ITEM: Consideration of approval of a resolution approving a Joint Fueling Facility 28E Agreement between the City of Waukee and the Waukee Community school District. FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The proposed 28E Agreement pertains to the construction of a joint fueling facility developed as a part of the transportation center project. The proposed fueling facility will be constructed and operated by the Waukee School District and jointly paid for by the City and the School District. The City will have joint use of the facility for fueling all of the City’s vehicles. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Per the terms of the agreement, the initial cost of the project will be 38% of the cost of construction. The percentage was determined based upon fueling receipts between the City of Waukee and the Waukee School District over the previous five years. Maintenance of the facility will be handled utilizing the same formula which will be recalculated every five years to account for the growth within the City as well as the District. COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: The City Attorney has reviewed and approved of the proposed 28E Agreement. The Waukee School District approved the 28E Agreement at their Board Meeting held on January 11, 2016. RECOMMENDATION: Approve the resolution. ATTACHMENTS: I. Proposed Resolution II. Property 28E Agreement – Fueling Facility PREPARED BY: Brad Deets REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: THE CITY OF WAUKEE, IOWA RESOLUTION 16- JOINT FUELING FACILITY 28E AGREEMENT BETWEEN THE CITY OF WAUKEE AND THE WAUKEE COMMUNITY SCHOOL DISTRICT IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County; AND, WHEREAS, the Waukee Community School District is a duly organized school district within Dallas County; AND, WHEREAS, the Waukee School District intends on constructing a transportation facility which will include the construction of a fueling facility; AND, WHEREAS, the City of Waukee sees a benefit in participation of the construction of the fueling facility to reduce the overall costs on fuel expenses for City owned vehicles; AND, WHEREAS, an agreement pursuant to Iowa Code Chapter 28E is proposed for the purpose of providing a formalized agreement between the City and the District to fund, construct and maintain the fueling facility for the use and benefit of both parties; AND, WHEREAS, the City Attorney has reviewed the proposed 28E Agreement and finds it satisfactory. NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 18th day of January, 2016, that it hereby approves the 28E Agreement between the City of Waukee and the Waukee Community Schooling District regarding the construction and operation of a joint fueling facility. ____________________________ William F.
