AGENDA ITEM: Consideration of approval of a resolution approving a Development
Agreement for Site Improvements [Waukee Transportation Facility]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: In coordination with the proposed transportation facility, a
regional storm water retention pond will be constructed at the intersection of
6th Street and University Avenue on approximately 4.5 acres. Approximately
21% of the proposed pond will accommodate the storm water management
requirements for the transportation facility with the remaining 79%
accommodating storm water requirements for the City including the Waukee
Public Works Facility as well as development within the original part of
Waukee to the north that was developed without any storm water retention.
The proposed pond is expected to help with flooding issues the City has
experienced in recent years downstream from this location, particularly within
the Sugar Creek Golf Course.
The proposed agreement identifies the improvements along with the
respective costs between the two entities. The agreement also identifies future
improvements to both 6th Street and University Avenue and the respective cost
splits between the City and the District when those projects are completed in
the future. Finally, the agreement includes a provision for annual
maintenance costs associated with University Avenue until such time as the
road is paved.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Based upon the
improvements proposed, the City’s anticipated costs of the project are
approximately $550,000, however, per the terms of the Exchange Agreement,
the District will be responsible for offsetting $200,000 of the City’s costs.
The project has been incorporated into the City’s Capital Improvements Plan.
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The City Attorney drafted this agreement. The Waukee
School District approved the Development Agreement at their Board Meeting
held on January 11, 2016.
RECOMMENDATION: Approve the resolution.

RESOLUTION 16-
DEVELOPMENT AGREEMENT FOR SITE IMPROVEMENTS [WAUKEE
TRANSPORTATION FACILITY]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas
County; AND,
WHEREAS, the Waukee Community School District is a duly organized school district
within Dallas County; AND,
WHEREAS, the Waukee School District intends on constructing a transportation facility
which will include improvements that will benefit the City; AND,
WHEREAS, an agreement is proposed which lays out the City and District
responsibilities for construction of initial improvements as well as future improvements
associated with the project.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 18th day of January, 2016, that it hereby approves the Development
Agreement between the City of Waukee and the Waukee Community Schooling District
regarding the construction of a transportation facility.
