Agreement between Shive-Hattery, Inc., and the City of Waukee [2015
Westown Parkway Improvement Project]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The original Agreement with Shive-Hattery was for
preliminary design, final design and bid process. The Amendment to the
Agreement scope of services include and environmental trees survey for
potential threatened and/or endangered species habitat, additional design for a
right turn land addition to R22, Construction Engineering, and completion of
as -build drawings.

RECOMMENDATION: Approve the resolution approving the Amendment to the Agreement

APPROVING AMENDMENT NO.2 TO AGREEMENT BETWEEN SHIVE-HATTERY,
INC., AND THE CITY OF WAUKEE [2015 WESTOWN PARKWAY IMPROVEMENT
PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on May 4, 2015, the Waukee City Council approved an Engineering Services
Agreement with Shive Hattery for civil engineering and land surveying services related to the
2015 Westown Parkway Improvement Project (Resolution 415-135); AND,
WHEREAS, on November 2, 2015, the Waukee City Council approved an amendment to said
Engineering Services Agreement related to wetland and stream delineation services for the
project as required by the U.S. Army Corps of Engineers (Resolution #15-376); AND,
WHEREAS, the City proposes an Amendment No. 2t to the Engineering Services Agreement
for services to include environmental tree survey for potentially threatened or endangered species
habitat, additional design for turn lanes, construction engineering, and completion of "as built'
drawings; AND,
WHEREAS, the engineering services amendment, attached hereto as Exhibit A, has been
reviewed and approved by the Waukee City Attorney.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that
Amendment No. 2 to Agreement between Shive-Hattery, Inc., and the City of Waukee [2015
Westown Parkway Improvement Project], is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 2"d day of February,
2016.

City of Waukee, Iowa and Shive-Hattery, Inc. (S-H) agree to amend the Original Agreement as follows:
A. SCOPE OF SERVICES:
1. Tree Survey
a. Visually survey and document the existing trees in the area that are potential
threatened and/or endangered species habitat. This is a result of information requested
by USACE in order to approve the project under a nationwide Section 404 permit.
b. Shive-Hattery to prepare memorandum on the trees and submit to USACE
c. Staking of Tree Removal Limits
2. Right Turn Lane addition to R-22 (Ute Ave)
a. A northbound right turn lane is to be added to R-22. The turn lane will be designed as
an urban turn lane with a 50' storage bay and 15:1 taper
b. Driveway into adjacent property will be reconfigured to accommodate right turn lane
c. Additional topographic survey will be required for the driveway
d. Temporary easement exhibits will be prepared for the right turn lane
e. Traffic control along R-22 will be modified to accommodate turn lane
3. Construction Engineering
a. Complete construction engineering and administration for the project, construction
engineering to include
I. Pre -construction Meeting
ii. Weekly on -site construction meetings (assumed April 2016-November 2016),
including meeting minute documentation
iii. Pay application processing monthly in coordination with Waukee on -site
construction representative
iv. Change order processing and approvals in coordination with City of Waukee
v. Shop drawing review
vi. Engineering of changes during construction of limited scope, changes resulting
from a change to the overall scope of the project would not be included in this
item. These include but are not limited to, changes to the length of the project,
typical section, length of turn lanes and tapers on R-22 would not be included.

vii. Final walk through and punchlist development
viii. Project Closeout
ix. Task does not include: Construction inspection or observation, material testing,
and safety inspections of any kind
b. As -built plans to be completed by Shive-Hattery.
i. As -built plans to be the design plans, revisions issued during construction, and
inclusion of field notes and data provided to Shive-Hattery by the City of
Waukee construction representative.
B. CLIENT RESPONSIBILITIES: Provide on -site construction representative to coordinate with
Shive-Hattery for preparation and processing of construction engineering and as -built related
items listed previously.
C. SCHEDULE: Construction scheduled to be substantially completed in 2016; final seeding and
site restoration may extend to spring of 2017. As -built survey may be completed in 2017
depending on construction completion date.
D. COMPENSATION: $56,700 Not To Exceed
1. Tree Survey: $3,000.00
2. Right Turn Lane Addition to R-22: $5,000.00
3. Construction Engineering and Administration, As Built Survey: $48,000.00 + $700.00
expenses, Total $48,700
E. ATTACHMENTS: NO CHANGE
F. AGREEMENT: This Amendment is subject to all other terms and conditions of the Original
Agreement. Return one signed copy to Shive-Hattery.
