AGENDA ITEM: Consideration of approval of a resolution approving Lease – Business
Property between the City of Waukee, Iowa and Waukee Post 737, the
American Legion, Department of Iowa, Inc. (410 6th Street)
FORMAT: Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The City of Waukee has a lease with the Waukee
American Legion for the Veteran’s Hall. City staff reviewed the terms
of the lease with representatives of the American Legion and made two
primary changes. The first is to eliminate the requirement that the
American Legion insure the building structure, since the City has
coverage on the building. The second is to include the Waukee VFW as
a party to the lease, since they have become a user of the facility. City
Attorney Brick and the City’s insurance agent have reviewed the revised
lease and have given it their approval. I respectfully recommend City
Council approval of the revised lease.

RESOLUTION 16-
APPROVING LEASE – BUSINESS PROPERTY BETWEEN THE CITY OF WAUKEE,
IOWA; WAUKEE POST 11517 VETERANS OF FOREIGN WARS OF THE UNITED
STATES, INC.; AND WAUKEE POST 737, THE AMERICAN LEGION, DEPARTMENT OF
IOWA, INC. (410 6TH STREET)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City owns the property locally known as 410 6th St, Waukee, Iowa which the City
formerly offered for use as the Waukee Community Center; AND,
WHEREAS, on April 6, 2009, the City Council held public hearing and approved a Lease – Business
Property between the City of Waukee and the Waukee Post 737, the American Legion, Department of
Iowa, Inc. (the “Tenant”) (Resolution #09-69); AND,
WHEREAS, the City and Tenant have negotiated a revised lease for the subject property, the terms of
which include the addition of Waukee Post 11517 Veterans of Foreign Wars of the United States, Inc.,
as Tenant; AND,
WHEREAS, the City Attorney has reviewed the proposed lease agreement and finds it satisfactory.
BE IT THEREFORE RESOLVED by the City Council of the City of Waukee that the Lease –
Business Property between the City of Waukee, Iowa; Waukee Post 11517 Veterans of Foreign Wars
of the United States, Inc.; and Waukee Post 737, the American Legion, Department of Iowa, Inc. is
hereby approved for a term to end at midnight on the 28th day of February, 2019, unless terminated in a
manner specified in the lease.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 2nd day of May, 2016.
