HomeMy WebLinkAbout2016-07-18-J06 Ordinance - Cat Licensing INTRO; 1ST-3RD READ AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: July 18, 2016 AGENDA ITEM: Consideration of approval of an ordinance to amend Chapter 209, Waukee Municipal Code, Regulation of the Licensing, Impounding, Immunization and Keeping of Cats, by amending certain sections pertaining to licensing and immunization [introduction; first, second and third (final) readings] FORMAT: Consent Agenda SYNOPSIS INCLUDING PRO & CON: On March 7, 2016, the Waukee City Council approved a resolution amending the FY2016-2017 Fee Schedule, which included fees related to dog and cat licenses. It is necessary to update Chapter 209 in order to correctly reflect that license fees are set via resolution, licenses are effective for the calendar year and no longer the fiscal year, and licenses are processed by the police department. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: City staff considers the ordinance a housekeeping matter and recommends approval of the first reading of the ordinance in title only and waiver of the second and third readings. The Code of Iowa requires a vote of not less than three-fourths of all the members of the council (or 4 out of 5, in Waukee’s case) in order to waive readings of an ordinance. RECOMMENDATION: Introduce the ordinance in title only, approve the first reading in title only, waive the second and third readings, and place the ordinance on final passage. ATTACHMENTS: I. AN ORDINANCE TO AMEND CHAPTER 209, WAUKEE MUNICIPAL CODE, REGULATION OF THE LICENSING, IMPOUNDING, IMMUNIZATION AND KEEPING OF CATS, BY AMENDING CERTAIN SECTIONS PERTAINING TO LICENSING AND IMMUNIZATION WHEREAS, on March 7, 2016, the Waukee City Council approved a resolution amending the FY2016-2017 Fee Schedule (Resolution #16-067); AND; WHEREAS, it is necessary to amend certain sections within Chapter 209, Waukee Municipal Code, Regulation of the Licensing, Impounding, Immunization and Keeping of Cats, in order to reflect cat license fees and license application and renewal dates enacted as part of Resolution #16-067; AND; WHEREAS, it is also necessary to amend certain sections within Chapter 208, Waukee Municipal Code, in order to accurately identify the department within the City of Waukee that shall be responsible for the issuance of cat licenses. BE IT ORDAINED by the City Council of the City of Waukee: Section 1. Chapter 209, Waukee Municipal Code, Section 209.2, should be and the same is hereby repealed and enacted in lieu thereof as follows: §209.2 License. All cats shall be licensed. Every owner of a cat shall procure a license from the Police Department on or before the first day of January of each year. The annual license fee for both an altered and unaltered cat shall be set by resolution of the city council. Upon payment of the license fee, the Police Department shall issue to the owner a license which shall contain the name of the owner, his place of residence, and a description of the cat. The Police Department shall keep a duplicate of each license issued as a public record. Upon issuance of the license, the Police Department shall deliver to the owner a metal tag stamped with the number of the license and the year for which it was issued. The license tag shall be securely fastened to a collar or harness which shall be worn by the cat for which the license is issued. Any cat found running at large without the license tag attached to its collar or harness shall be deemed unlicensed. It shall be a violation of this ordinance for any owner to own or possess a cat within the city of Waukee without obtaining a license in compliance with this section. Section 2. Chapter 209, Waukee Municipal Code, Section 209.3, should be and the same is hereby repealed and enacted in lieu thereof as follows: 2 §209.3 Immunization. Every owner of any cat over the age of three (3) months shall, when procuring a cat license from the Police Department, present a certificate from a qualified doctor of veterinary medicine that such cat has had immunization against rabies, and such certificate shall show the date of such immunization and the term of such immunization. The Police Department shall not issue any cat license until evidence is shown certifying a rabies vaccination of the cat by a licensed veterinarian. If any cat for which a license has been obtained shall not have attained the age of three (3) months at the time of the licensing of such cat, the owner shall, not less than ten (10) days after such cat attains the age of three (3) months, secure immunization against rabies for such cat and present a certificate as required in this section to the Police Department who shall enter such certification in the records of the city. It shall be a violation of this ordinance for any owner to own or possess a cat within the City of Waukee without furnishing a certificate of immunization against rabies in compliance with this section. Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 5. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
