FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: Ashworth Properties has provided the necessary deed for the swapping of approximately 0.35 acres of property along the north side of the retention ponds along Grand Prairie Parkway in exchange for the same size parcel currently owned by the City. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution. Proposed Resolution PREPARED BY: Brad Deets REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: THE CITY OF WAUKEE, IOWA RESOLUTION 16-________ APPROVING A PROPOSAL TO DISPOSE OF THE CITY’S INTEREST IN REAL PROPERTY IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City holds property as part of a detention pond, a portion of which the City believes is excess property legally described as: A PARCEL OF LAND IN THE SOUTHEAST 1/4 OF SECTION 4, TOWNSHIP 78 NORTH, RANGE 26 WEST OF THE 5th P.M., CITY OF WAUKEE, DALLAS COUNTY, IOWA, THAT IS MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AS A POINT OF REFERENCE AT THE EAST 1/4 CORNER OF SAID SECTION4; THENCE S83°55'59"W, 1228.97 FEET ALONG THE NORTH LINE OF SAID SOUTHEAST 1/4 TO A POINT ON THE EAST RIGHT-OF-WAY LINE OF GRAND PRAIRIE PARKWAY; THENCE S00°27'39"W, 10.02 FEET ALONG THE EAST RIGHT-OF-WAY LINE OF GRAND PRAIRIE PARKWAY TO A POINT OF CURVATURE; THENCE SOUTHERLY ALONG A CURVE TO THE RIGHT HAVING A RADIUS OF 1587.50 FEET AND A CHORD BEARING OF S16°29'37"W, AN ARC LENGTH OF 888.45 FEET ALONG THE EAST RIGHT-OF-WAY LINE OF GRAND PRAIRIE PARKWAY TO THE POINT OF BEGINNING; THENCE S54°00'54"E, 366.41 FEET TO A POINT ON THE SOUTH LINE OF THE PROPERTY DEEDED TO THE CITY OF WAUKEE IN BOOK 2012, PAGE 23867; THENCE WESTERLY ALONG A CURVE TO THE RIGHT HAVING A RADIUS OF 900.00 FEET AND A CHORD BEARING OF N65°03'18"W, AN ARC LENGTH OF 306.05 FEET ALONG THE SOUTH LINE OF SAID WAUKEE PROPERTY TO A POINT OF TANGENCY; THENCE N55°18'48"W, 65.00 FEET ALONG THE SOUTH LINE OF SAID WAUKEE PROPERTY TO A POINT ON THE EAST RIGHT-OF-WAY LINE OF GRAND PRAIRIE PARKWAY; THENCE NORTHERLY ALONG A CURVE TO THE LEFT HAVING A RADIUS OF 1587.50 FEET AND A CHORD BEARING OF N33°36'24"E, AN ARC LENGTH OF 59.85 FEET ALONG THE EAST RIGHT- OF-WAY LINE OF GRAND PRAIRIE PARKWAY TO THE POINT OF BEGINNING AND CONTAINING 0.3503 ACRES MORE OR LESS; AND WHEREAS, Ashworth Properties, Inc. has approached the City and offered to exchange property of the same size in exchange for the conveyance of the above-described property to Ashworth Properties, Inc.; AND WHEREAS, the property being disposed is not needed as part of the detention pond the City has constructed and the property Ashworth Properties, Inc. proposes to convey to the City is of the same size and will serve a public purpose. BE IT THEREFORE RESOLVED by the City Council of the City of Waukee, after a public hearing held on August 1, 2016 to consider the disposal of the property described above in exchange for property owned by Ashworth Properties, Inc. known as Parcel Number 17-93 on the Plat of Survey on file with the City Clerk with the City of Waukee, hereby approves the disposal of property by conveyance to Ashworth Properties, Inc. by Quit Claim Deed Parcel Number 17-94 upon receipt of a Warranty Deed from Ashworth Properties, Inc., free and clear of any liens or encumbrances, of Parcel 17-93. The Mayor is authorized to execute any and all documents to effectuate the transaction and convey the property on behalf of the City.
