AGENDA ITEM: Consideration of approval of an amendment to the Professional Services
Agreement with Genus Landscape Architects in the amount of $7,550.00.
FORMAT: Consent
SYNOPSIS INCLUDING PRO & CON: This amendment is due to the additional site surveying
that was needed prior to the Fox Creek Park project. (3.G)Soil from the
developer was stockpiled on the park land and was originally figured into the
overall grading plan. Once the developer removed the soil, a new survey was
required. (3.H) This amendment also covers the engineering that was needed
for the Landing at Shadow Creek 8” subdrain that was a part of the original
bid package, but was not anticipated in the original design work. (3.J)
Construction Administration: It was determined after the original contract
with Genus that they would complete all of the site inspections as it relates to
the trails and earthwork. Originally these services were anticipated to be
completed by the City of Waukee engineering techs. Due to work load, it was
determined that Genus would be responsible for the inspections, thus
requiring additional site visits. The fees associated with this work were
anticipated and directly relate to Change Order #1 that decreased the contract
amount by $46,068.00.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $7,550.00

APPROVING PROFESSIONAL SERVICES AGREEMENT AMENDMENT NO. 1
WITH GENUS LANDSCAPE ARCHITECTS [FOX CREEK PARK IMPROVEMENT
PROJECT, PHASE 1]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on October 19, 2015, the Waukee City Council approved an Agreement for
Engineering Services with Genus Landscape Architects related to the Fox Creek Park
Improvement Project, Phase 1 (Resolution #15-370); AND,
WHEREAS, the City proposes an Amendment to the Engineering Services Agreement, attached
hereto as Exhibit A, toward reimbursable expenses and compensation for construction
administration.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Professional Services Agreement Amendment No. 1 with Genus Landscape Architects [Fox
Creek Park Improvement Project, Phase 1] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 15th day of August,
2016.

Amendment to Contract . Fox Creek Park Phase 1
Submitted: August 11, 2016
1. This amendment (the "Amendment") is made by Genus Landscape
Architects, P.C. and City of Waukee, parties to the Agreement for
Professional Consulting Services Fox Creek Park Phase 1, dated
October 19, 2015.
2. The Agreement is amended to change the following:
“3.AI F. Reimbursable Expenses [ NTE ]” should read $1,800, instead
of $1,300. The original total contract amount is unchanged.
3. The Agreement is amended to include the following additional
services to “ 3. Compensation”.
G. Site survey for ‘dirt stockpile area’ $ 1,100
H. Shadow Creek 8” subdrain engineering $ 2,210
I. Preparation of easements $ 840
J. Construction Administration [ 8 visits ] $ 3,400
Total added to agreement $ 7,550
The total agreement amount shall be revised to: $67,350.
4. Except as set forth in this Amendment, the Agreement is unaffected
and shall continue in full force and effect in accordance with its
terms. If there is conflict between this amendment and the
Agreement or any earlier amendment, the terms of this amendment
will prevail.
