AGENDA ITEM: Consideration of approval of a resolution approving final plat for Fox
Creek Estates Plat 7
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON:
TCB Investments, LLC, is requesting approval of a final plat for approximately 24.47 acres of
property located north of NE Douglas Parkway and east of NE Dartmoor Drive. The final plat
consists of a total of 65 single-family residential lots. Lots range in size from 8,493 square feet to
17,806 square feet.
NE Bobcat Drive and NE Wolfpack Drive have been extended from previous phases of Fox
Creek Estates. NE Owl Ridge Lane, NE Jaguar Lane, NE Hawk Circle, and NE Fox Valley Drive
are new streets that have been constructed for this development.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request at their meeting on June 28, 2016
and recommended approval.
Approval of a Final Plat for Fox Creek Estates Plat 7
City Planner Melissa De Boer introduced the request for a final plat located north of NE Douglas
and NE Dartmoor Drive. The property is approximately 24.47 acres in size and has a zoning of R-
2 One and Two Family Residential. The plat will consist of 65 single family lots ranging in size
from 8500 to 18000 square feet, and an Out lot Z dedicated to storm water detention which will
be maintained by an HOA. The plat will bring in several new streets as well as extend the existing
street of NE Bobcat Drive and NE Wolf Pack Drive. Staff is comfortable recommending
approval subject to remaining staff comments and review of the legal documents by the city
attorney.
Commissioner Streit questioned if this was the last of the Fox Creek Estates to which
Development Director Brad Deets replied that there would be 2 more sections left.
Commissioner Streit moved for Approval of a Final Plat for Fox Creek Estates Plat 7 subject to
remaining staff comments and review of the legal documents by the city attorney, seconded by
Commissioner Hoifeldt. Ayes: Nigro, Fontenot, Streit, Hoifeldt, and Schmidt. Nays: None.
Motion Carries.
STAFF REVIEW AND COMMENT: All staff comments related to the final plat have been
addressed and staff would recommend approval.
RECOMMENDATION: Approve the Resolution.

APPROVING THE FINAL PLAT FOR FOX CREEK ESTATES PLAT 7
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, TCB Investments, LLC, has requested final approval of Fox Creek Estates Plat 7
(the “Plat”); AND
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of
the Plat on June 28, 2016, subject to remaining staff comments and review of the legal
documents; AND,
WHEREAS, the Final Plat for Fox Creek Estates Plat 7 and the documents relating thereto will
comply with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa
on this 15th day of August, 2016, that the Final Plat for Fox Creek Estates Plat 7 be and the same
is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
easements and documents to be filed with the Plat:
1. Warranty Deed;
2. Landscape Buffer Easement;
3. Public Utility Easement;
4. Overland Flowage Easement;
5. Storm Sewer Easement;
6. Sanitary Sewer Easement;
7. Snow Storage Easement;
8. Traffic Easement

BACKGROUND:
The proposed final plat is a continuation of the Fox Creek Estates development. The subject property is
located north of Grant-Ragan Elementary School, which is currently under construction. The final plat includes
a total of 65 single family lots.

Project Description:
Lots:
The final plat includes 65 single family residential lots. The lots range in size from 8,493 square feet to 17,806
square feet. The lot frontages range in width from 65 feet to 85 feet. All lots will have the standard 30 foot
front and rear setback along with the standard 15 foot (total) side setback.
Outlot Z is identified on the plat as being used for storm water detention. The plat notes that Outlot Z will be
owned and maintained by a homeowners association.
Streets:
NE Bobcat Drive and NE Wolf Pack Drive will be extended from the east plat boundary of Fox Creek Estates
Plat 6 through the development. NE Owl Ridge Lane, NE Jaguar Lane, NE Hawk Circle, and NE Fox Valley
Drive are new City streets that will be constructed as part of this plat.
Easements:
Several easements are proposed within the plat based upon the location of proposed utilities.
Utilities:
Sanitary sewer, storm sewer, and water main have been extended throughout the plat as part of the public
improvements. In addition, sanitary, storm, and water services will be provided to each lot.

Parkland Dedication:
Parkland dedication for this plat has been satisfied with the approval of Fox Creek Estates Plat 4.
STAFF RECOMMENDATION
At this time Staff feels comfortable with the proposal and would recommend approval of the Final Plat for Fox
Creek Estates Plat 7 subject to remaining staff comments, review of the legal documents by the City Attorney,
and completion of public improvements.

PLATTING FEES
6. A check should be provided satisfying the following fees:
a. $978.80 [$40.00/acre: for 24.47 acres] should be provided to satisfy the warning siren fee.
b. $124,293.40 [$5,079.42/acre: for 24.47 acres] should be provided to satisfy the Little Walnut
Creek Regional Lift Station costs related to sanitary sewer connection.

7. All legal documents should be submitted prior to forwarding to City Council.
