AGENDA ITEM: Consideration of approval of a resolution approving a pre-annexation
agreement with Shadow Creek Estates, LLC
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The City of Waukee and City of Clive have an existing
28E Agreement pertaining to annexation of specific properties located within
each other’s City’s.
Shadow Creek Estates, LLC, owner of approximately 13.44 acres of property
that has been designated within the area of Clive that has the ability to be
annexed to Waukee has agreed to terms of a pre-annexation agreement.
It is anticipated that the property owned by Shadow Creek Estates will be
developed as single family residential lots and the terms of the pre-annexation
agreement pertain to the development of the property.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff would recommend approval of the pre-annexation
agreement.
RECOMMENDATION: Approve the resolution.

RESOLUTION 16-
RESOLUTION APPROVING PRE-ANNEXATION AGREEMENT
WITH SHADOW CREEK DEVELOPMENT, LLC
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, Shadow Creek Development, LLC., submitted a preannexation agreement and
application for voluntary annexation seeking Council approval of the annexation agreement and
the Voluntary Annexation of their property to the City;
WHEREAS, the City Council having considered the preannexation agreement with Shadow
Creek Development, LLC, finds that the same should be approved subject to the Completion of
the annexation of the property that is the subject of said agreement.
BE IT FURTHER RESOLVED, that the preannexation agreement submitted for consideration
by the City Council of the City of Waukee and executed by the property owner Shadow Creek
Development, LLC should be and the same is hereby approved subject to completion of the
annexation of the property that is the subject of said agreement as contemplated therein.
